Biden administration asks judge to limit DACA ruling.

The Biden administration on Thursday asked a federal judge in Texas to stop short of ordering the full termination of the Deferred Action for Childhood Arrivals (DACA) immigration policy if he finds it unlawful, a last-minute attempt to limit a looming ruling that could dictate the fate of nearly 600,000 "Dreamers."

The Justice Department's filing late Thursday was part of the last set of filings ordered by U.S. District Judge Andrew Hanen, who is reviewing a request by a coalition of Republican-led states led by Texas to terminate DACA over a two-year period. With all filings submitted, Hanen could issue a decision at any time.

In its filing Thursday, the Biden administration said Hanen should uphold the legality of the new rules. But it conceded that the 5th Circuit had already declared DACA unlawful.

If Hanen finds the DACA regulations unlawful, the Justice Department said he should only strike down parts of the program, such as the work permit provision, and give the Department of Homeland Security (DHS) time to make changes to the policy.

Any ruling in favor of the Republican-led states, the Justice Department argued, should only apply in Texas since only that state "has attempted to show" it is harmed financially by DACA.

In the event that Hanen moves to void the regulations, he should pause his order to ensure DACA recipients are able to continue renewing their deportation protections and work permits while the government appeals the ruling, the Justice Department said. The administration also asked Hanen to let DHS impose a wind-down period for DACA, instead of imposing one himself, if a ruling against the program is upheld by higher courts.

seems like Hanen is holding up the ruling to make sure we are in the middle of the elections again. Trump or RFK winning is s win for us. but DeSatan would be the end of us which is about to announce himself on May.

and according to this DACA is beyond fked.

The analysis states that because Biden's administration did NOT change the DACA program before asking for public comment and filing in the fed register, Hanen and the 5th circuit are ruling on the original DACA, and that is why it will likely die. After all of this time. Obama also did not file in the register or ask for public comment in his haste to write the memo. Wow. Is this incompetence or intentional? They left out the Dreamers that have lived in the U.S. the longest like IAMAN out of the program without a legitimate known reason. Is this incompetence or intentional?

A farmworker who has been feeding this nation for 25 yrs cannot have a work permit, but people are encouraged and supported by the Biden admin to sponsor Ukranians and Cubans and Venezuelans and they are immediately eligible to have work authorization.

They want to continue to exploit undocumented labor.

the demonrat party and their organizations are our greatest enemy.

organizations like United We Dream RIGHT NOW are not covering ANYTHING in regards to this nor the new Florida bill. but they sure as hell are covering LGBTQ issues to the dot.

the ONLY one that i see so far actually keeping an eye on all this is ACLU and thats it.

its about to get horrible for us. imagine, right now the average DACA is making over $28 an hour. which means they are holding high level positions at most jobs.

they are using us for fkin elections and thats it.

So original DACA dies but Biden DACA remains since they gave proper notice for the unchanged new DACA is my understanding.
