Got DACA too late to have that deal with unlawful presence/reentry bar issues.

So the only question is - are your parents LPRs/USCs?

Unfortunately no.
So basically marriage is still the only way - even with the new policies proposed by Biden, is that right?

Pretty much yeah. Though PIP wouldn't help you any since that's really only for wiping out EWIs.

Then there's the other part of the non-immigrant waivers which is honestly too messy to try. Even if the hospital tried to get you an H-1B (or similar) 212(d)(3) waivers are strictly discretionary and trying to sue over a consular denial is a road to nowhere should that happen. Then there's the last part where the D3 waiver doesn't do anything for the 10 year ban when it comes to permanent residency so you'd need to wait that out which brings us to the next issue where H-1Bs are generally issued for up to 6 years (3 years intial + one 3 year renewal) renewing further would require you to come from a backlogged country (China or India) to be able to get over the 10 year mark.

Change of status is one way to about this but change of status to what? If you are Mexican or Canadian then TN might be an option but physician isn't on the list of jobs they want.


So yeah, just marriage realistically.

Who in your family has legal status?

With your kind of education and work I am pretty sure you can get a Visa to Canada or other countries if you want to leave.

Since you are earning there. I would stay there until a law helps you.
