Post is to document my journey and hopefully shed some light to future applicants:

I am preparing my documents to apply for (PIP). Initially, we were going in the route of I-130/ 601A hardship waiver, but we decided to try this out. It's almost like stars aligning considering that we just got married last year. I was very skeptical about 601A waiver and leaving to my home country in South Korea. First 601A hardship is very difficult process to approve, and South Korea has military mandate for all males under 35 years of age possibly triggering detainment when I'm in the process of 601A.

Married: 05/05/2023
Filed I-130: 08/02/2024
PIP filing pending: 08/19/2024

Parole in place filed today. Probably one of the first as I was for DACA!

Thank for sharing your experience on this new program, I too qualify but have been on the fence about applying. I’ve had DACA since its inception and have been married to USC for 15 years. I need to get over my fears and just apply, we’ve made it this far/long..right. Best of luck on your journey.

Texas and 16 other states sue the program and put to halt as of 08/26/2024. No changes to my application status... it's still being reviewed atm...

If you do not mind me asking, did you enter without inspection?

My brother is married to a USC, is from South Korea, and AFAIK has no issue filing for adjustment of status since EWI is not an issue.

Perhaps, I am missing something?

I see. Best of luck!

I am myself, trying to do the h1b process, but am a bit hesitant about visiting Korea - even with AP.

This is first time seeing this kind of path. Have you EWI? I thought if you are married with the US citizen and entered through inspection + visa overstay you can just use I-485 and I-130 to receive your temporary green card? Also as for the Korean military you can apply for a military entrance extension (which will let you renw your Korean passport) if your parents are also living in the states with you even if they don’t have green cards or citizens…
