Qualify for U visa?

I recently moved into a new apartment building and been here for 2 months now and have a crazy neighbor who is harassing me and calling the cops for no reason and giving them our address? It’s become annoying, this lady curses me out when she sees me and calls the cops and gives our address. Cops come and ask if anyone called the cops.

What can I do? Does this qualify for U visa? My boyfriend whom I live with told our landlady and the landlady told him to ignore her and that she has her good days and she has her back days LOL. I mean, she’s giving me stress I do not need. I literally have done nothing to her and she calls me a lil “sl*t” when she sees me and says nothing to my boyfriend. Crazy Karen. Anyways, what are my options? Thanks.

No you don’t qualify for a uvisa. You’d need to prove this was a hate crime and a cop needs to vouch for you.

I mean that'd be pretty hard to argue. Only crime from the qualifying list that even remotely fit would be stalking. You could maybe also argue that making false police calls is substantially similar to perjury but that's a tough sell.

Of course it's an uphill battle where you want to document that the neighbor keeps making false police calls (get the reports and 911 recordings) and then have the cops or the DA actually bring charges.

You can give it a shot but don't expect miracles.

If she keeps up the harassment, then I will go to the local precinct and complain about all these false police calls and that they need to trace the calls and everything. It could be a hate crime because she says nothing to my boyfriend and he is white and I am not. I feel threatened by her behavior and constant harassment so it could be my life is in danger cuz you don’t know what crazy can do.

I will start documenting and maybe even recording her on video when she makes comments and curses at me unprovoked. She usually does that on the street while I am sitting in the balcony so it is a public place and I can record her. If she keeps up the harassment, I will go to the local precinct and complain because this calling the cops and giving out my address all the time is getting annoying.

It’s annoying and that’s all there is to it. If the cops haven’t ticked her for making false police reports. How exactly are you going to prove it’s a hate crime and your life is at risks?

UPDATE: As I was leaving the building today, crazy neighbor was sitting in her balcony and proceeded to curse me out and threaten me. I recorded her and went to the local precinct. All the cops in the local precinct knew this woman cuz apparently she calls the cops all the time

The police had me file a harassment claim against her. They said I can also file a restraining order. Are my chances for U visa looking good now?

In a case like this it probably won't fly. Cops in NYC are pretty damn useless for anything other than people skipping fares on the trains. Like dressing it all up as stalking or something similar to perjury was a stretch to begin with.

So yeah, doesn't look good. Maybe if you got a restraining order a violation of such could be dressed as stalking but that's still a long shot.
