Obviously, there is a serious misunderstanding here. aztec isn't talking about driver's licenses, he/she is talking about professional employment licenses, such as real estate brokerage licenses or stockbroker licenses.

So yes, professional employment licenses are awarded by independent regulatory organizations and any exam is also administered by these IROs. The state doesn't administer any exam but requires a person to have the license because the license holders have to maintain high professional standards, educational capabilities, and ethical regulations. The state would like the employees to have this license which is why states require the license to practice.

Now it all depends on what type of license you are looking to obtain. Its really not upto the state to award the license. Contact the agency or regulatory organization that deals with brokerage and ask them.

For example, in New York, undocumented people can obtain securities brokerage and financial advisement licenses after they pass the appropriate exam. But that doesn't do them any good because they can't work.

Have you tried to do this? I never had the need to get securities licenses since my reports are not resold, only in-house, but I'm thinking since we'll be stuck in this situation for a while I might try to get some of them. Can we simply sit for some of the exams without having papers or obviously being employed by a company?

Oh most definitely. You don't need to prove your immigration status to take these exams. The two popular exams are the Series 7 and Series 63. However, for the Series 7, you need an employer to sponsor you to take the exam. The Series 63 doesn't require any sponsorship. You can contact the National Association of Securities Dealers (NASD) or the North American Securities Administrator Association (NASAA) for information on how to register for the exams.

I'm not sure of this but I've heard that the license isn't awarded by simply passing the exams. There is also a requirement to accumulate some years of work experience, which is the major deterrent to us. I've passed the Series 63 exam, and right now I'm studying for the second exam of the Chartered Financial Analyst (CFA) charter.

Bottom line, there is no problem to take the exams.
