Some of you have may still qualify is you had a bad lawyer that wrongly claimed you aged out, double check this ASAP. Time is crucial. Also keep in mind that your stay before 18 does not hurt you however once you turn 18, the clock starts ticking and the 10 year ban sets in not long after that. So seek the advice of multiple lawyers ASAP. *If you are about to turn 18, make sure you have a legal way of re-entering before leaving the country. The last thing you want is to be stranded in a foreign country with no legal way of coming back.


so my question is:
*is it true that if you are under 18, the 10 year banning rule is yielded??? or i heard that at least ban entering to US for 3-5 years instead of 10 years ..?

i really gotta know the truth because i am turning 18 in two weeks and if this is true, i am really determined to go back to my country..

Unlawful presence and illegal entry do not count against you if you are under the age of 18. Once you turn 18, the clock on your unlawful presence starts ticking. At 180 days after your 18th birthday (18 1/2), if you are still unlawfully present in the United States, then you will receive a three year ban the moment you leave the country. One year after your 18th birthday, you will receive a 10 year ban. If you are less than 18 1/2, then you have no ban.

Talk to a lawyer before you decide to go back to your country though and consider your options. It might be a better idea for you to wait for Dream, or you might be able to come here on a student visa. Think about all your options first.

By the way, if you don't have money for a lawyer, you should set up a consultation with Heather L. Poole. She does free consultations and she's very knowledgable. She's in California, but we had a consultation with her even though we're in Texas. She just calls you up. You can set up the appointment on her website.

I don't care what people tell you but if you leave even if you are under 18, they won't let you back in. If you go to apply for another visa and they find out you had overstayed before they will deny you.

^ He's right. The only reason I would recommend someone leave was if they came here EWI (without a visa) and knew they were going to get married to their boy/girlfriend immediately.

lilbawler is right. Accrued unlawful presence isn't the only cause of the 10 year ban. Just having any unlawful presence is usually enough to ban you from entry.
