Yea, if he left right after it expired (within a year) He will not face the ban. That is probably why they left. With that information, i THINK he may be able to come back to the U.S and visit, and of course once he gets everything sorted, to live

Caliplaya, can you find out if he had employment authorization during the entire time that he stayed here? My question is, when did he first receive his work authorization and did it stay valid till recently?

Because lane is correct. If he had EAD all the time while he was here, then he was never in unlawful status. Even if he just had the EAD only after 16 years old till now, then he may still be able to return and not be affected by by the 10 year ban.

He showed it to me yesterday, if I remember correctly that individual card he showed me was valid from March of 2007 to February 14, 2008...i am almost sure of the 2/14/08, but not sure if the card said march of 2007 or not...i will certainly ask when we speak..

i dont know if this helps but when we were 18 (in 2005) we both worked for a movie theater in town...i dont remember exactly what kind of documentation they asked for..we also worked a tutoring job together while in high school....

Hey, just try to pull through this. He may have a chance. Does he not have phone services set up yet in the Philippines? Once you're able to contact him, call him and ask him about the EAD and how long he had it...get as much information from him as you could. Until then, there's not much a point in asking for advice on what you know, because you might get your hopes up or get depressed, when his chances will turn out to be the opposite once we have all the information.

Nope, no phone service yet, I don't expect to hear from him for a day or 2. He is still on the airplane as I speak. Yea I understand what your saying, I appreciate all of the help.
