Is there any possible way that I can obtain one? My cousin just got his the other day and he is illegal, but he has had his visa and it doesn't expire till 2010..I don't think it's fair because I've been here way longer than he has. I just need a driver's license. I am tired of driving and being scared. Oh and another thing, have any of you tried to return something at a store and they ask for your driver's license? That has happened to me 2 times lately and I say I don't have one and they say I can't return it. It blows.

his visa isn't expired, then he is legal and it is perfectly fair for him to get a DL.

His visa may not expire till 2010 but you should ask him when his I-94 expires. If his I-94 has expired then he is unlawfully here and shouldn't be able to obtain a driver's license. If he did, then either he did it fraudulently or the DMV people didn't understand what documents to look for and inadvertently issued him a driver's license. Either scenario is likely. If you want to bet on the DMV getting it wrong in your case, then thats your call.

What state do you live in? 44 states (including the four largest CA, NY, TX, FL) require proof of legal status to issue a driver's license; the other six states require that you maintain a residency within the state for the previous 6-12 months. I'm not sure which six states but you can look it up on Google.

As for returning items to the store, the store wants to make sure that you are the person who indeed purchased the item and are returning it for a refund. This prevents people from stealing other people's stuff and then returning them to the store for money.
