For those who have their Green Card through AOS. Have you guys travel outside the U.S yet? If so how was the process when entering the United States post trump era?

I have a question

My girlfriend who is a green card holder and not a US citizen so if i get married to her can she still petition me or would i have to wait until she gets her citizenship first.

Every lawyer will tell you to wait until she gets her citizenship it's far less complicated and in most cases the only way to go .

Are you EWI? If you are she will not be able to do anything for you . Since unlawful presence is only forgiven to immediate family of us citizens .


If you decided to go ahead and apply you will have to wait for a visa number to be available which could be anywhere between 4 to 5 years depending on your country of origin . And again this is only if you're even able to do this .

I traveled post-Trump being elected but before he took office and I had to go through secondary inspection much like I did when I traveled with AP. My wife (USC) and I went to secondary inspection and waited for around 45 mins, but they never asked us any questions just called me up and gave me my green card and passport and told me to have a good day. It was kinda weird. This happened at Chicago Airport (O'Hare).

She can file I-130 on your behalf. This will place you into F2A category, which currently is backlogged about 18 months. Majority of F2A numbers are not subject to per-country limit, which is why Mexico is only backlogged about 3 months more than the rest of the world.

If she naturalizes the petition will be upgraded from F2A to IR.

Now, if she barely got her green card, then you can proceed, and when your priority date becomes current you'd file I-601A waiver. (You cannot adjust status this way unless you're covered under 245(i)).

If she naturalizes then your petition will immediately become upgraded to Immediate Relative petition. So when it's approved or she naturalizes, whichever comes later if you entered US legally you'll be able to file for AOS. If you entered US illegally you can play the AP roulette or do I-601A waiver.

I-601A waiver is available for anyone that:
1) Has an approved petition with current priority date (or won the green card lottery). This includes Immediate relative petitions, all family petitions, and all labor petitions.
2) Has a US citizen or LPR, parent or spouse, who'd suffer "extreme hardship" from the applicant's absence.
