I don't mind waiting I just wish I knew for sure. The guy that was approved here had a removal order over 10 years old so that magical number "10 years" might be needed?

lol this is me going crazy but in 2000 did they use computers to save application and immigration history?

Same here man. My wifeys in med school right now and i dont want to burden her and her family with my problems until she finishes school. She has two years left, so it works out perfectly once i get a two year DACA approval. I also have a decent job so im not in any rush just as long as DACA comes through.

HI GUYS! FIRST TIME I POST HERE. I also have a final order and I sent the letter from the judge. My mom failed to assist court for me in 2003! Im wondering if that is the reason why I haven't been approved yet. I meet all the requirements, Im so nervous for not hearing anything yet from my case!

well let me tell u, my mom has TPS for a long time and she still has the order of deportation, unless u get marry or do something else with a lawyer, u will have the order of deportation after 2 years of daca.

Quick question... on your application did you put your original A number from your previous case? And if so does your fingerprint date paper have the same A number?

I am in removal proceeding, my lawyer said after I am approved, we will try to close the case. Is order of deportation same thing as being in removal proceeding? Another lawyer said, the my case will be just pushed back and not closed. It doesn't make sense when DACA is supposedly renewable...

I doubt even the lawers know how they are processing removal proceeding case and deportation order cases. In the past if you had removal proceedings for what ever reason and lets say you get married and received your green card - you would still have removal order because it was handled separately. You must take care of each case or risk being deported. The good thing is deportation case and deferred action they are both handled by USCIS. Most likely they will adjust both case when they approve you that's why it's taking so long to approve our application. On their website it does say if you are in removal proceedings or have a final order of removal you qualify which says to me they will adjust everything according but i'm no lawyer. Keep in mind everyone who does this process will automatically have removal order if not renewed in two years like with most other USCIS applications so this is no different from other deferred action case with clean history.

When is your next court date? If you get a good judge i'm sure they will close your case there and then but if not you will be able to push your date back some more until deferred action is approved and then close your case. You should contact USCIS regarding your case status and hearing date just to make sure once you receive your deferred action approval. This is the only way to know and since there are very few people with removal proceedings getting approved as of now no one knows...

That does make somewhat sense. My court date is August 2013. Defensive asylum case. Hopefully things work out on my side. Thanks for the detailed response. Appreciate it.

No, there was no frivolous finding. The asylum case was just denied.

I've been through that and like many others asylum did not save me. Every case is different but you have lived here way too long for them to even consider asylum a strong ground. (but again every case is different)

But no worries i'm sure they will be willing to administratively close your case if not terminate.
