Senate is voting on cloture. Votes are 50 yeas, 48 nays. McTurtle hasn't voted yet (but he's basically a yea), McCain is dead or dying and not present therefore a no. So the de facto tally is 51-49. With 60 yeas needed.

If a majority leader votes a motion down it can be called for another vote at a later date. Arcane rules of the senate.

If he were to vote yes then this bill cannot be reconsidered without at least some changes. Keep in mind both houses have to pass identical bills. They just wanted to pass the house CR and be done.
