Afaik,All persons applying would have to be under 35 years of age on the date of enactment.The bill clearly states that if however you reached over that age subsequently during your process,then it would be up to USCIS completely on what to do administratively,consider it more of a loophole in the law.

You have to be under 35 to attempt an associate degree or 2 years of military service.

Section 6 "Retroactive Benefits Provision" specifically excludes "35 and under" age cap for those who already met all requirements for permanent residency conditions. This is why the MPI study included an estimation on how many illegals over 35 had a degree as they would benefit under this provision and the number came out to be 14K.

The requirement (f) is removed for Section 6 provision. This is why 35 year old and older can benefit if they already have a college degree, so the illegals who are above the age cap but received their degree by this summer are qualified, since the ones graduating in December are out of luck if the Dream Act is passed in October.

Now, I need an answer on whether people who departed the US for more than 90 days at a time prior to 2005 would qualify, because that's my problem.
