Dude, can't you read? god damnit. If it's moved forward to 1996, no, you would not qualify, but perhaps you will if it's moved to another date. Nothing's certain.

Is the memo stating it MAY consider giving TPS to those here before 1996 (or another date) or granting them green cards?

Ohh.. And can one adjust under TPS if there is a family petition currently available for a visa?

The Administration probably leaked this to Republicans basically threatening that if they don't come to the table and negotiate in good faith, they'll move on this by themselves.

I think the "move to 1996" statement means they can move the amnesty date enacted in the 1986 immigration law from 1972 to 1996. I don't think they can go beyond 1996 because 1996 was the year the 1996 immigration law was enacted.

I came here before '96 but for the sake of others, I hope the dream doesn't change. But I honestly think the reason why it hasn't passed is because its not specific enough. Its too broad doesn't deter others from coming, which doesn't satisfy a lot of conservatives.

No you can't leave the country with Deferred action as Abaddon mentioned.You would require 'advance parole' in order to even make it remotely possible of returning to the US.I've seen some whom have used "Advance Parole" twice but only due to family emergencies in there home country.....and even then it is a tense situation if CBP allows you to enter the US or denies you entry and formally starts removal proceedings.Neither time did the person have "deferred action".

The Memo is huge in that it talks about the "Registry" provision under INA which deals with Permanent residency,NOT Temporary protected status.

Your next question would be kinda difficult to explain but it depends not only if the person is in legal status currently but also how they entered the US.A person could have entered the US illegally gained TPS and still not be able to adjust status in the US,while those that may have came legally,gained TPS can subsequently have their stay adjusted in the US.It completely depends on whom the petition is based on and their current circumstance,thus an explanation might be too broad for the scenario.


BTW @ CIR,Noticed a pattern with the numbers lol,every 14 years ?1972 Registry provision,1986 IRCA,2000 LIFE Act.........could this be the reason some pundits switch to 2014-15 being the year ? I also believe the limit for updating the Registry provision to 1996 is because of the IIRIRA act of 1996 signed by President Clinton.Going beyond that could actually interfere with current interpretation of the 1996 laws and could be a nightmare for the judicial system therefore the Administration or any implementation might actually be limited to 1996 for this reason.

If they actually went through with this, what date in 1996 would they update the registry to? I know IIRIRA was signed at the end of September.
