These are very good points. I knew there were some issues w/ F-1. 1184(I) should not be a problem. I think i can see where 1101 (a)(15)(F)(i), might cause problems, but then again how can intention of never returning be measured? I was on F-1 for the last 5 years, I know if i become illegal on this, then prob. don't qualify. I will look into this, but ..... what if i can prove i became illegal when my parents worked on F-1, therefore I became out of status immediately(on F-2)) too and my F-1 later on should not have been issued, since illegals can't get a visa? I hope they take this part out thou. I'll have to look into this, got some Homework and workarounds to find.

I will post my findings in few days on this...

The issue that I observe is you never really got a student visa while in your foreign country, you came on a tourist visa first and then got an F-2 because you had a parent on an F-1, and eventually you became of an age where you could get the F-1, but I'd imagine you did not have a permanent residence in your home country to which you would state an obligation to return to after completion of your education. I'd imagine that the reason for 6(G) being included on the DREAM Act is that contractual agreement in the first place, where the applicant says they will return home becoming the basis of why the entrance is permitted in the first place.

But yeah, it makes no sense if the applicant only knows this country to begin with and does not really have a place they can call home in the foreign country, or even remember the foreign country to begin with.

well, this is my life....life on F-1, F-2 is not fun at all. You can't do anything and you pay thousands of dollars in tuition to do nothing. I don't know if i will qualify or not....but i will have to see the application when it passes. If they don't ask me for anything like A# or SSN, i don't see how they can track me. I will have to talk to a top lawyer, but one thing is for sure, I will apply regardless...you never know when and and they will approve. Would my sister qualify? she is the same story as me but never made it to F-1...she became illegal on F-2 when she went over 21.
