Yeah we're included in this Action, we'll have to apply through the USCIS along with everyone who came in any other way and have never had any encounters with the law. lol Those will have to deal with ICE. God bless us all. T.T'

But yeah, they never mentioned anything about disclosing how exactly we came in and proving so. They just specified how we will be applying comparing to others.

Yes. An individual subject to a final order of removal who can demonstrate that he or she meets the eligibility criteria can request a review of his or her case and receive deferred action for a period of two years, subject to renewal. All cases will be considered on an individualized basis.

on the bottom there is also a chart that says to apply to U.S. Citizenship and Immigration Services (USCIS) when the application period opens

Now is this not true?
From what I got from the conference call today, if your in removal your case is already being handled by ICE not USCIS. Someone correct me if am wrong. USCIS will only handle case for deferred action for those that are not in removal.

Hm, that's a good question. They haven't mentioned anything in regards to interviews yet (correct me if I'm wrong as well). All that's been said for people in our case is that we will have to go through the process with USCIS. I sort of doubt they will have one on one interviews simply because I don't think they really care how you came in and this is not an adjustment of status. Maybe, just maybe, on the application it might ask whether you came in on a visa at first and perhaps something about the visas for those who had them, which in our case would be left blank lol. But yeah, I don't think there will be interviews, if anything, we would only stand out based on questions on the application (my guess?).

That's why I think it will be even more important for us to have significant records to show up our continuous presence here in the states.

Every single case will probably be different, hence why they said on a case-by-case basis.

I also don't think it will require an interview for the Deferred Action. However, I think one is required for the work permit, correct me if I m wrong, anyone?
