Executive order? I think people in this forum have way more knowledge than the random "activists" out there. First of all, is not an executive order, it was a memorandum by Sec. Napolitano to use discretion, under the presidency of Obama. If you guys want to wait for it, then go ahead, by I'm damn sure that many dreamers are waiting for opportunities like this. I take my chances an apply for this as soon as this comes out, I have nothing to loose but a lot to gain.

Only work permit needs to be renewd every 2 years.

Yeah,the Deferred action is the status for which the EAD is based on so it will have to be renewed as well as the EAD.

I think the Government stands to make a huge amount of money as it can be renewed indefinitely if the regulations are still around.

On the issue of Mitt Romney,considering he will be the front runner over some of the most conservative of individuals voting in the country I wouldn't be surprised if he pandered for an overturn while in office.

We have to maintain eligibility for Deferred Action every time we renew -- for us, it means no crimes on our record that disqualify us. So I imagine that every time we reapply, we'll have to undergo another background check, and also show proof that we have been remained in the US.

If it's anything like TPS, it's simply a formal application process letting USCIS, you are still here, and wish to continue receiving benefits.

As for the "Executive Order" mix-up, this is why I have no patience when you are forced to go through people. Like calling an office, and having the secretary supposedly trying to inform you but giving you complete, blatant wrong information on everything. And don't even get me started on when you have to call "customer support" -- always ending up knowing more than the reps.

Then if it's anyone like the woman in the OP (who's educated and has title of Dr), you feel like an ass correcting them (so you just smile courteously, and nod).

Effectively this is an executive order although it's not called that.

The president has the power to hire/fire the AG at will and it's absolutely certain that Napolitano either received the order from the president or contacted him before making this move. The reason why Napolitano did this is two fold: 1) to shield the president from critique ("this is an agency-level policy, not an executive order"); and,2) to make a stronger argument that the action that the agency is taking is within its bound (because if the president had released an EO, then people'd be saying that he's creating laws out of thin air; if an agency does this, then they're claiming that they had this power all along).

tl;dr: Romney can have his AG issue an order that they're prioritizing deportation of possible DREAM Act beneficiaries just as easily as Obama's executive did the whole Napolitano memo.
