The record may have been erased from the 'state archives' but the feds don't follow the same rules. It may show up in their background checks. Employers often reject applications w/sealed records because they don't know if the crime was petty theft or attempted murder. I hope USCIS is not as prejudicial.

Following normal USCIS procedures as I have posted in the first post, since I was below the age of 18, this should not matter anymore. And actually no, employers CANNOT reject applications with seal records if you are above 18 and five (for oregon at least) have pass and you have not have not done anything beside that, you can ask the court for expungement. And you can put NO if employer ask if you have been charged, convicted or accused and can SUE them if they have research you beyond what the expungement has let out. At least this how it works for juvenile cases.
Back to my case
It seems I need to have a background check but I need a rap sheet which shows all and any records that I have with the law.
What are the requirements for a background check and where can I get one?
