I've thought about this and looked into this a while ago after DACA was announced. What I found was not really positive. Other people with work permits generally have a hard time getting sponsorship from what I've read. I know of a couple of guys who were foreign students, but are currently working with their work permits, but they have to leave the country to get permanent residency. What I'm going to do and what I would suggest other people look into is immigrating to another country such as Canada or Australia. Australia changed their immigration rules and they have a new point system which I think makes it easier to immigrate there if you have the right degree and experience. Basically, if I'm granted EAD I'm going to explore all my options and try to adjust my status here, but I will also apply for Canada and Australia and maybe even the UK.

That's not how it should work. If he's applying for his green card through marriage, there is no reason to leave the country to complete the process. Why would his lawyer stop his green card application in order to apply for DACA. Sounds a bit suspect to me.

He needs to leave if he came without inspection.

I have heard that by the end of this year, if you adjust and came without inspection, that people won't have to do the waiting in their country, meaning that you will be able to wait for an answer here and then go back only to get your visa if you got approved. This will serve to lessen the time that families have to be separated.

There was an announcement a while back dealing with this, it had to do with petitions with extenuating circumstances, where a US citizen would be considerably burdened if the petitionee would be forced to serve the length of the 10 year ban.

Before you would have to leave and ask for permission from the outside, if denied you had to serve the 10 year ban, now you can ask for permission before leaving, if denied, you have not left.

But in regards to what you are mentioning, I have not heard anything regarding the end of this year that being the case.

case in point, but demonstrating extenuating circumstances to get the pardon that way is very tricky, it involves making a very strong case, which requires a very good lawyer that is experienced on this process.
