Well Both applications (i-821D, i-765) required a background check, a clean record is one of the guidelines for DACA, as the case number you might be right they can pick either one since both require background checks.

Well, none of this shit matters anymore. I just found out you can't make work authorization denial appeals:

§ Sec. 274a.12 Classes of aliens authorized to accept employment. (DACA is covered under this)

(a) General . Aliens authorized to be employed under section 274a.12(a)(3) , (a)(4), (a)(6)-(8 ), (a)(10)-(15), and (a)(20) must file an Application for Employment Authorization (Form I-765) in order to obtain documentation evidencing this fact. (Introductory text revised effective 10/17/07; 72 FR 53014 ) (Paragraph (a) revised 1/4/95; 59 FR 62284 ) (Paragraph (a) revised 6/3/95; 60 FR 21973 )

Sec. 274a.13 Application for employment authorization.
274a.13(c) Denial of application . If the application is denied, the applicant shall be notified in writing of the decision and the reasons for the denial. There shall be no appeal from the denial of the application.

Wow I can't imagine being denied! Why??? I don't have any criminal record! Doesnt it mean that Once they route ur application to a ASC that means that you have met all the requirements and they trusted to until they check ur background to make sure ur no lying?? Right???
