You can apply for advance parol.. You'll leave but you're not guaranteed a re-entry.. So if you feel like putting your faith in some customs agent who probably isn't fond of illegals granted legal presence then be my guest.. Don't come on here crying that they won't let you back in.. Leave at your own risk.. I've had a lot of relatives pass, my grandfather just last year.. I wish I could of been there but I couldn't.. Life goes on, CIR could pass and there could be a "must be here on this day" just like there was for DACA.. Might get you excluded.. I wouldn't risk it.. But then again you're not me and you can do what you please, just know your risk and weigh out if its worth taking it.

i need professional help not your personal opinion. i find it really offensive the attitude that you are taking towards my problem. you are not me and it's not your relative neither. so you don't know who this person was to me.

thanks for the link. i have been investigating a lot. and i consulted it with my lawyer too. He told me that as long as my I-131 gets approved i can come back.

I personally wouldnt risk it it says clearly on uscis website on the card that comes w your EAD that there is a high chance you can get rejected at the border, all depending on the immigration officer. And i didnt see it as a negative way that happyman0607 was trying to tell you. Just advice. I mean that is what we are here for is ADVICE. Are you really coming here on a page that is full of people that are going through the same thing as you asking for "PROFESSIONAL HELP"? This is not the place. You paid a lawyer right you should have gone to him from the start. Sorry that you dont find our advice useful. But then again we are not LAWYERS nobody on this page is. We are just telling you what we have heard and read. (:

As of right now, USCIS is still using the old instructions for Advance Parole where it says that if you have been Unlawfully Present in the United States, you can be denied re-entry from the United States.

USCIS is looking to change this and they made a proposal to change the rules. One of them being that if your only form of inadmissibility is Unlawful Presence, you will not be denied re-entry.

Leaving the United States with an Advance Parole Document is a “departure” from the United States for all purposes under the U.S. immigration laws except that it is not a “departure” solely for purposes of inadmissibility under INA section 212(a)(9)(B) (inadmissibility due to prior unlawful presence), if you are paroled into the United States on the basis of such document. Any other departures without first obtaining Advance Parole may subject you to the inadmissibility provisions of INA 212(a)(9)(B).

This isn't the law yet though, so I'm not sure if you can travel right now without any problems.

This is what is says:

Parole into the United States is not Guaranteed - In all cases you are still subject to immigration inspection at a port of entry to determine whether you are eligible to return to the united states under the terms of this advance parole. If you travel outside the United States you may use the combo card to seek parole upon your return. However, the fact that you have this combo cars does not prevent the Department of Homeland Security (DHS), in the exercise OF ITS DISCRETION, from refusing to parole you into the United States if DHS determines that parole no longer serves the public interest of the United States.

Thats STRAIGHT FROM the card that i got from USCIS.

"HOWEVER THE FACT THAT YOU HAVE THIS COMBO CARD DOES NOT PREVENT THE DEPARTMENT OF HOMELAND SECURITY (DHS) IN THE EXERCISE OF ITS DISCRETION (meaning they do not have to tell you why or explain why) FROM REFUSING TO PAROLE YOU INTO THE UNITED STATES"

So i do believe they can not let you in if they just dont like you... lol smh

Parole into the United States is not an admission- If your form i-485 is denied you may be subject to removal proceedings as an inadmissible alien under sections 212(a) and 235(b)(1) or 240 of the Act rather than as a deportable alien under sections 237(a) and 240 of the Act.

DHS reserves the authority, at any time, to revoke your advance parole, whether you are in the United States or aboard. If DHS revokes your advance parole, then you will no longer be authorized to use this combo card to board a plane, ship, or any other carrier for travel to the United States, nor will you be able to apply for parole at a port of entry with the combo card. If the Department of Homeland Security revokes your advance parole while you are outside the United States, your combo card will no longer be valid for travel. If the Department of Homeland Security revokes your advance parole, you may not be able to return to the United States, unless you are eligible for, and obtain, a visa or other valid travel document.

You need professional help yet you come on this site asking for help from "non" professionals.. Great logic champ..

We all have the same problem.. I bet you 99% of the people here have had "your" problem.. My grandfather recently passed away and I didn't go so yes I know where you're coming from. I don't appreciate your attitude.. If you can't take the heat get out of the kitchen.. I'm giving you an answer that everyone gets, I don't know you and I don't want to know you.. It is what it is my friend.. Go apply for AP, if something happens don't cry about it cause you now know the risk and so does everyone else.

we can travel within the US though? will a drivers license be sufficient or still need a passport?
