Ok, so highest we have seen is 35. I hope they have 35 and under than. Why do you say 34.99?
The language is ambiguous, it sounds like it could be 35.99 and under, but then that could be interpreted as being "under the age of 36 on the date of enactment of this act".

It is clear.

(F) the alien was 35 years of age or younger on the date of the enactment of this Act.

The alien was 35 years of age OR younger which means IF the bill were to enactment today and tomorrow the alien turns 36 than the alien qualifies.

We had lot of discussion on the age cap on DACA.

Yeah, the thing is that for immigration purposes, exceeding the age cap by a very short period of time isn't a problem in some cases, but you are most likely right, under the age of 36 it seems.

Under extenuating circumstances up to 60 days does not seem to be a problem, but you have to prove it.
