These are very serious charges. USCIS could hand over your case to ICE. The larceny and obstruction of justice charges I believe may be interpreted as 'significant misdemeanors'. It only takes a conviction of one to lose DACA, and be rendered removable.

A criminal defense attorney who specializes in the consequences of immigration convictions should be seeked.

I have a public defender I can't afford a private attorney and I just found out its obstructing a officer not obstruction of justice i don't know if that's the same or less bad but yes I really need the larceny misdemeanor taken out.

I forgot to mention about "breaking and entering", which is technically burglary.

You're going to need an attorney for both criminal and immigration proceedings.

If all these charges are true then you should not qualify for DACA. Sorry. You are ineligible according to USCIS guidelines. I sincerely think Admins should take down threads like these. We are regular DACA beneficiaries, not some high roller attorneys who can give advice on advanced matters like this one and also outsiders reading threads like these will start thinking we are all involved in doing similar things and spread bad rumors about DAP.

we can't give any legal advice. i hope your public defender has some sort of special relationship with the DA. i hope with all my heart and soul that you're not in anaheim, CA.

even after charges are dropped, this guy knew what he was getting into. Hes not DACA anymore.

Being charged does not prevent you from renewing (presumption of innocence), however if you get convicted or are about to then you're better off just boarding the first plane out of US since you will not be eligible for any reform or adjustment pathway in the future, nor for renewing your DACA. The conviction will likely result in jailtime, and subsequent deportation.

Listen, a public defender will not cut it for what you have to lose. If keeping your DACA is extremely important to you, you need to get it together and hire someone ASAP! you got yourself in this mess and now you need to get yourself out and learn from this. If you have decided that you will wing it with the public defender you honestly dont deserve to have DACA.

Yeah that's all we need. It's not like immigration reform and executive action don't have enough bad press with the idiots from South America sending their kids here alone and Obama getting blamed for it because he started DACA. Now we just need criminals getting on DACA.

I want to say "we've all done dumb things when we were kids", but come on man, breaking into cars is a piece of shit move. I've had my car broken into and have relatives who had to spend $700 to fix a broken lock that someone thought was hilarious to try to punch out.

Republicans aren't our worst enemy, our fellow immigrants are.

Late 40's Dreamer (Holy Fucking shit I'm almost 50 and still dealing with this), aged out of original DACA and didn't have a chance to apply for extended DACA after Republicans killed it on the vine.
