He can claim the Credit as long as he hasn't claimed it for 4 years. Doesn't matter if he's on his masters or doctoral program.

Yes by the looks of it I don't think he has claimed it. He should be able to but it seems like people are just not getting the fact that the IRS does not give a shit about your immigration status. For tax purposes, we are all resident aliens. End of matter.
