JUST IN: Fifth Circuit Blocks Biden DACA Regulations for Texas Only - Page 2

When the Supreme Court upheld the block on the Trump administration's effort to terminate DACA, Justice Roberts suggested that DACA as deportation protections only, but without the benefit of a work permit, might be legal. And today the 5th Circuit agreed.

Crucially, the Biden admin's DACA regulation had a severability clause saying that if a court struck down the work permits, the deportation protections should remain. Judge Hanen ignored that. The 5th Circuit seems to have given the Biden admin a partial victory on appeal.

I believe that losing work permits and maintaining DACA could potentially be the worst-case scenario, although it is not certain. I am hopeful that the Supreme Court will consider the positive impact of Dreamers on the economy and possibly allow the program to continue without accepting new applications.

I hope so too! I also believe that if the courts wanted to terminate the program, they would have done so years ago. The fact that the program is still in place suggests that there is a reason for its continuation.

We have been making positive contributions and have invested a lot into this program, so dismantling it would not be beneficial for anyone involved. Perhaps this is why Donald Trump has also softened his stance on DACA - we are not bad people.

The problem is Stephen Miller, the NYT did a profile on him yesterday. He's basically the one in charge of everything.

I still think Trump overrides him and Elon Musk's position on immigration benefits us as well.

We all know Stephen Miller is not our friend. But I do believe we may be reading too much into his actions. There have been reports suggesting that someone from his team leaked information indicating that even President Trump feels Stephen’s views on immigration are excessive and that they do not see eye-to-eye on everything.

The immediate termination of DACA needs to happen on Inaguration Day so that Trump and Elon can save us DACA kids. Trump did not run on killing DACA this time. He will save us for sure.

All this is setting the stage for a massive border bill by summer

The GOP will want funding for deportations and detainment, asylum changes, and ending birthright citizenship for children of illegal immigrants and visitors visa..

I think this is where daca/dreamers will be used as the key bargaining chip.
