so i did an e request in 7/03/2013 didnt receive no email no txt messages however these a holes did sent me a letter stating this

"this notice acknowledges receipt of your status inquiry concerning your pending request for deferred action.Your case has remained pending beyond the expected six month processing period.We recognize your interest in a final decision on your pending request and are aware of the difficulties caused by any delay in processing.The california service center is committed to processing this workload, and will be making every effort to review your case in an expeditious fashion as soon as available under our resource constraints."



pretty much means that my packet is stuck somewhere without having being looked at , and they dont have the enough officers yet to look at it right ? , i know alot of other people have gotten this same crap , those who have what were the next steps you guys took ?

Well i wrote my congressman. This is the reply they got from USCIS....

USCIS records confirm your constituent’s I-821D requestor and I-765 application are pending background check clearance. USCIS is committed to adjudicating immigration benefits in a timely manner while also ensuring public safety and national security. A small percentage of applications and petitions have unresolved background check issues that temporarily delay adjudication. Although USCIS makes every effort to resolve such cases promptly, USCIS is unable to speculate when the background check will be completed.

If a background check reveals an issue that may impact an applicant’s eligibility for the requested immigration benefit, further inquiry is needed. The inquiry may include an additional interview and/or contact with another agency for updates or more comprehensive information. Upon gathering and assessing all available information, USCIS will adjudicate the application as quickly as possible.

USCIS realizes your constituent may be frustrated by the progress of their case. However, the agency must balance individual inconvenience against broader issues of public safety and national security.

If they have not heard anything within three months, please inquire again and we will search to see why the I-821D requestor and the I-765 application have not been completed.

I did everything that I could think of and I still got the same BS from them. I guess i'll get approved in 1 year or later. I will have 11 MONTHS this August 11.

do you have some type of criminal background ? , i think your name must of matched up to someone elses unfortunately

Most likely u still stuck on the background check, my lawyer told me my case was stuck at the background check until June 27, and they finally looked at my file and decided I need a few simple RFE, we sent it in and 8 days later approved. So just be patient, they will review your case as soon as the background check go through. I know it's a long wait, but the result is totally worth it.

Just called them and said their system is down how convenient this wait is not fun but hoping for more approvals! I'm on October 24th by the way California center.
