Quick update: I originally received my EAD with a wrong DOB on Jan. 1o and went to apply for a SS, but it didn't went through because of the wrong DOB. I sent everything USCIS asked for on Jan. 16 and received a confirmation that they got it on Feb 4. As of today, I haven't heard anything back from them, but today I got a letter from the SS office saying that I apply for a card on Jan. 10, and that I should be receiving my SS card in about two weeks. Hopefully that's a sign that my EAD is about to come too! fingers cross!!!

I also got a typo on my EAD card. I called USCIS and told me all the things I needed to do. We found out the typo was done on the end of my lawyer when she filled out the I-765 (EAD) form. My lawyer went ahead and wrote in the cover letter that it was still USCIS fault for not cross referencing with the documents I sent them.

Here's my timeline

01/18/2013 - I received my EAD card with the wrong birthdate. That same day I called USCIS to see what I can do to fix it. The woman I spoke to told me that I can get it expedited if I can prove that the error was done by USCIS. If so, then I wouldn't have to pay the fee again. If it was my fault, then I would pay the fee again and my case would take up to 3 months. Without speaking to my lawyer I went ahead and asked for it to be expedited. The woman said that within 15 days I would get a letter from USCIS stating what my next steps would be.
01/23/13 - I received an email from USCIS stating my next steps. In the letter it stated that I would have to send the incorrect EAD card, a letter explaining the error, A completed Form I-765 application with box 2 – Replacement checked, and supporting documentation to verify the accurate information for correction, such as birth certificate, passport … etc.

01/23-02/07 - I met with my lawyer. We decided to explain why it was USCIS error. We mentioned that it was their error because they didn't cross reference with the paperwork I sent them and because they had my DACA birthdate correct.

02/08 - Mailed the EAD card, letter, I-765 form, and paperwork by confirmed mail.
02/14 - USCIS received my paperwork. My case went back to Initial Review. Under the bubble it had this written on "February 14th, 2013, we received your APPLICATION FOR EMPLOYMENT AUTHORIZATION, with a letter from you."
02/26 - I checked the USCIS website for an update. While my case was still under Initial Review, there was a new message under the Initial Review bubble. It read "On February 26, 2013, your date of birth was updated relating to your I765, APPLICATION FOR EMPLOYMENT AUTHORIZATION. Please check our website at www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance."

Does anyone have an idea of how long this is gonna take? Also, does this mean that I wont have to pay the fee again?

Hello!!

Your case is very very similar to mine. My lawyer sent everything back some weeks ago.. and I recieved two weeks ago my confirmation saying they had recieved my case... and to wait for biometrics... I still haven't gotten them.. I don't know if they will ask you for biometrics like me.

I checked the receipt I received for my i-797c and the mistake was there also. I cannot believe I hadn't noticed such typographical error. I hope to receive my EAD card tomorrow and I am hoping everything will be spelled correctly since in my biometrics I made sure that they had typed in my name and DOB correctly.
NOOOO!!!! I received my EAD card today, March 4, in the mail. But my last name was spelled wrong as I had suspected. I will now be calling USCIS.

Can I just send back the card with proof or do I have to wait for them to send me the information?

I think you should talk to your lawyer about it. All USCIS is gonna tell you is that youll have to wait 15 days for a service request then you'll get a letter stating you should send the card back. The sooner you send it back along with a new application and photocopies of your birth certificate and your pasport uou should be good to go. And send it through "certified mail" so that you can track it.
