That's not true, he entered with inspection.. But with a different passport/name pretending to be his aunt/uncle son.. He didn't come in with a US passport or someone else's GC.. This is why i say you shouldn't lie and you should consult a lawyer.. I know a few people who came in with a passport that didn't have their name and they were able to adjust in country.... yes you can file with the lockbox without leaving but i don't remember what the requirements are

go on immigrate2us and you'll find a few member who came in the same way you did and was able to adjust in country.. i know one from brazil who was able to and got her 10 year GC.. i think she had to file a waiver for misrepresentation

Yo, this is all hearsay. Why? Not because people are wrong. On the contrary, they're all right...to some extent. It varies by state (more correctly, by circuit) whether they're right or wrong.

That said, get a lawyer. A good one. And talk to him/her about it.

As for biometrics, you can get them with your college ID. Take your high school ones, too, along with your birth certificate, and be prepared to tell them why you can't show a passport.

Is there a difference between EWI and Entry with fraud....

yes there is.. EWI, you entered without inspection and you can't adjust in country unless someone filed for you before 2001.. But now you can do the lockbox.. Entry with fraud as long as it's not a US passport or GC then it's something that can usually be fixed by filling a waiver and hiring a good lawyer.. OP came in with a passport with his pic on it, he was inspected even though he had a different name/dob.. Make sure you still have that passport and I-94... What is it that you don't get ECW??? Give laurel scott, Lizz cannon or laura hernandez a call

I think the OP mentioned he already had a lawyer....I think we can all agree on one thing this is going to be a VERY expensive fix.

Ok for now I think that my best option is to get a Washington ID and use that for the biometrics. Hopefully (if everything goes well), I will be able to apply for a passport with the EAD as proof of legal status (temporarily legal w/e). I really hate my consulate... they're really strict about the legal status thing but I'm going to try going there again next week.

EWI or Overstay... tough decision.
Well, my lawyer said that I should be honest with USCIS because you never know what USCIS knows about you. I doubt they know anything because they didn't take fingerprints back then... She mentioned a 601 waiver that I would have to submit because I used fraudulent documents but its not in effect yet or something.
The 601 wavier was for when I was trying to apply under my parents case NOT for deferred action.

In my opinion, I think it would be better if I put EWI because there are less risks involved. I would be able to adjust in the future since I'm a derivative of my parents closed 245i case.
