Just read the final rule and I guess people did bring up/commented to expand the eligibility, it didn't happen though. At least it was mentioned:

Shame, lot of the people meet 3 of those categories already lol

Question here is why weren't you included on your mother's green card petition? If you were to leave US before turning 18 and had your mother file for you you could have gotten your green card by 2010, but who wants to wait abroad for 4 years.

Only option for adjustment for you is marriage to a citizen. If you arrived on a visa it can be done with no waivers. If you entered illegally you will need the provisional waiver.

The thing is, I don't think there's any way for them to prove that. He's done quite well for himself, he's 23 this month, owns a home, manages a business, etc.

I guess CIR is their next option.

so then as of right now, the "new" waiver ONLY applies to those under 21?? who are immediate relatives of USCs

Not necessarily age being the cut off, but rather the 'immediate relative' definition by the USCIS:

- Spouse of USC
- Child of USC under 21
- Parent of USC (with USC over 21)

even though i am a child of a USC, i am 29. so i dont think this waiver could apply to me

i'm kind of in the same boat. i'm 29 and my mom is a USC. she filed an I-130 for me back in 2001.

i think right now it's for kids under 21 because then a visa would be immediately available to them when their parent becomes a USC.
My goodness me and you have almost similar situations only that I am a year older.

Right now, one would not have to leave country if qualified under 245i.

I thought the extreme hardship waiver always existed? So what will be different now?

What if waiver gets denied?

the waiver always did exist.

the 245(i) only applies to those who filed an I-130 before April 30th 2001..

i believe that if the waiver gets denied, that you would be subject to the 3 to 10 yr ban when leaving the country for your visa
