I'm sorry about your grandpa, I'm on the same boat.

What I have found so far is that it should be safe but no one knows for sure because we don't know many who have attempted it. One girl posted on this forum that she left and came back without a problem and she even had photos to prove it. We haven't heard of anyone else even attempting it.

I've met with USCIS officers and many different lawyers and get conflicting answers. They either tell me that it's totally safe or they say they don't know so I shouldn't risk it. The USCIS officer guaranteed me it was safe to travel once you get approved and even though it's not up to USCIS, I honestly believe it'll be ok. They wouldn't even make it an option for us if we couldn't since the vast majority of DACAs have over a year of unlawful presence.

All I know is that I'm in the process of gathering evidence in order to mail in my application. If you do end up going through with it, please keep us posted? I will do the same!

You can use a DL for domestic flights, or any other valid photo document (I've traveled using my passport with an expired visa before - they only check the identity page).

ive posted this in other threads but ill post it here too since alot of people seem to have the same question

For DACA folks who want to travel abroad..
Have there been any Advance Parole approvals for DACA beneficiaries who wish to travel abroad?

There have been a few approvals for Advance Parole documents for individuals with Deferred Action. The cases we know of have been for school-related activities (i.e. sports team traveling, studying abroad, etc.)

*Note that the dates on the Advance Parole document are VERY restrictive (i.e. if you ask for 4 days for a sports trip, you will get 4 days. If the returning flight is canceled or delayed to the next day, the individual will be at risk of not being able to return).

Also, all the approvals we've seen have been for a single entry. If someone has various trips that require multiple entries (e.g. 4 soccer trips this year), it might be worth trying to apply for all in one request.

While the Advance Parole notice states that leaving the U.S. on Advance Parole with DACA is not a departure for 3/10 year bar purposes, we suggest that individuals consult with an attorney before leaving the U.S.

We recommend that anyone thinking of applying for Advance Parole should do so, and then consult an attorney when it is approved and in hand. Processing times, and the changing landscape of DACA, and the various other complexities, grounds of inadmissibility, possible need to close out deportation proceedings, etc. should be evaluated.

Lastly, if some form of Immigration Reform passes while the individual is abroad, it is possible they would not be eligible for legalization.

He is kind of right though! I'm sure your grandpa wouldnot want you to chance your future for him. Be strong and use technolofy, videocall or something!

i have called immigration several times and told them my case (without lies ) and they all tell the same thing: that it is safe as long as i get my I-131 approved

i went to my local immigration office and they told me the same thing ( i did not mention to them that i had called immigration already) . The immigration office told me they have approved cases like mine and the people do return to the U.S.A without problems.

My lawyer tells me the same thing, he is actually very good and well recognized in my area.

I am keeping up with the process and yes i will let you know how everything goes.


I laso found this link, and i think it has response to a lot of the questions that have been posted in this forum.

thanks for the help. actually my grandpa is in intensive care; he can't speak neither..... he wanted to speak with me before he went into intensive care.
