Makes perfect sense.

I'm assuming I was denied the first time. USCIS did not report me to ICE since I did not get a NTA (noticed to appear) and was accepted the second time.
USCIS goes by guideline and determines who it reports.

Do you have a link of the dreamers with an old DUI?

I dont have any cases with me I can link you but if you use the Dream Act Search and use dreamer deported cases will appear.

There isnt much you can do now but just wait and see what happens

I don't think that's right. If USCIS has granted you protection then you're covered so long as nothing new happens to make you lose it. If your reasoning were true, then all overstayers would be subject to deportation regardless of DACA. What counts is what happens AFTER you are granted deferred action. That's why all of those arrested were for new crimes or because their coverage lapsed and their DACA had expired.

well, i don't know, a lot of the deport cases I read though the months, the a lot of the deportees had a DUI done in the past

What I read is most Dreamers got a DUI while on DACA. I haven't found any with a DUI before DACA that were deported while on DACA

In my case I got it before DACA even existed.

I know some dreams with DACA that just got a DUI they expunge their DUI and sent the renewal I'm waiting on their outcome.

Again - USCIs won't send ice to you the problem as we keep telling you is IF for whatever reason ice detains you and finds that old dui it might be enough for them to deport you.

I am in the same boat as the OG poster. However i have renewed twice successfully, but not with the new administration. I did get the expungement before applying the first time and my lawyer did a great job putting the package together.

Its going to be tough and scary renewing during this administration. I haven't been able to find anyone who has successfully renewed under these circumstances with the new administration. So if anyone can share that would be great.

Here's the good. we have already been granted DACA (twice in my case) with the expungement and as long as you have nothing else on your record, it should technically be the same process.

Here's the bad. Every time you renew its almost like filing a new application. You go under the same process of review. An officer will use and exercise what they see fit at their discretion. So technically they could deny you because every application is on a case by case basis.

But thats like saying, you were good before and now your not . . .wouldn't make much sense. But at the end we just have to see if anyone else has had success. as others have said, they already have your info, and the worse is not taking the chance to file because you'll be left completely open and unprotected.

I have looked into this. At least according to the lawyer I met with, said its nearly impposible and improbable to use this for a misdeameanor DUI. This is more for those with felonies.

However i have read some stories online doing it successfully. Maybe you can share your lawyer information (via PM).
