The answer to the other question I get a lot for, should I apply before 8/8 I wouldn't advise anything, I'm not a lawyer. If you send it in now, it will get worked when we get to it (as of 7/20/2018 we were working cases from 6/19/201. If you wait and send it in later, it will get worked when we get to it. If there's some sort of injunction, we have no idea what that will do this time (the August 8 one). It could completely get rid of DACA in which case it doesn't matter when you submit it cause it won't ever be worked. If you send it in now there's a small chance (very small) we would still work cases (when the 10/5/2017 injunction originally happened, we had 6 months, 3/5/2018, to finish all cashes we had on hand). If it's a decision to get rid of DACA, then it's probably going to stop all DACA that day (8/8/201

In that case, most likely all cases we have that haven't been worked will be rejected, in which case you get a refund so it doesn't hurt to submit now. -- Historically USCIS doesn't keep money for cases we don't work. We refund it.

But there's also a 50/50 chance they could just deny all pending cases and keep your fee as well, in which case you are out $495 and DACA and if you waited to submit you would still be out of DACA and $495 richer.

So, I have no clue what to recommend, because we don't have any idea what will happen on 8/8/2018. If $495 is a lot to you, then wait. If it is not, then submit now.

I sent in my shit in Jan and mine expires in March 2019. Yeah plenty of ppl got theirs approved. Why I am the unlucky one? Lol.

I don't think it will matter whether you are unlucky or not. If the judge ends DACA, it will be the end of DACA for all of us, not just those whose renewal applications haven't been approved yet. So, even those "lucky" ones will lose their DACA status like you. In other words, if the judge does something bad, it will be bad for all of us, not just some of us.

Mine expires April 2019, and I sent my renewal a few weeks ago. I already received a biometrics appointment and will walk in before the appointment. I doubt I will get renewed on time though the way things seem.

If Judge Hanen issues an injunction that stops all renewals (very likely), the urgency will be back because the country will have a patchwork of people who are protected and those who aren't. I cannot fathom the issue being delayed to the presidential election with this shit going on. Insane.

NOTE: Any stay applications to the Supreme Court would likely be considered this summer (of 201 while the Supreme Court is not in session. For a stay to be granted, five Supreme Court justices must be in favor of granting it. If a stay is not granted, the order(s) already issued by the U.S. courts of appeals and/or district courts will remain in effect.


Isn't Kennedy retiring this week? So if it ends up 4-4, the district courts ruling would be held?

Seems like a "Yes." But, who knows how the decisions will be reconciled. I guess we can only wait. Nobody knows.
