I had a question regarding filing AOS - the application asks to list your parents (and their address). If they are undocumented, would this put them at risk? From what I've read, it's always been touted that USCIS doesn't cooporate with ICE. In this political atmostphere, however, I'm not sure how true this is. Has anyone's families faced any issues with ICE after filing?

No, that won't put them at risk. I'm sure we would hear about it if it had ever happened. I haven't heard of a single case where listing one's parents on the I-485 got them deported.

Hey guys, have any of you had any issues with I-864 (Affidavit of Support)? My wife makes more than the 125% above the poverty line BUT she has not filed her taxes in the last 2 years, which caught me by surprise and pissed me off, so what we did was send all her bank statements for the last past 3 years. So I received an RFE for I-864 asking me to send in my wife's taxes or get a co-sponsor. So I opted to get a co-sponsor, which makes well over the 125% of the poverty line, I self filed BTW. Have any of guys gone through the same thing or something similar? Is this something major to worry about? Also how long does this set me back on the waiting list?

How did you not know that your wife hasn't filed her taxes for the last 2 years? Have you been filing your taxes? Why aren't you filing married filing jointly for immigration purposes. Anyway, if you got a co-sponsor, I don't see why there would be an issue if they make enough money to sponsor you.

I assumed she has been filing her taxes since she has her own business but to my surprise she didn't for the last 2 years. We haven't filed our taxes together because we got married February of this year. Yes, I've been filing my taxes longer then most US citizens, since I was 18 using my ITIN number and when I got my SSN with DACA I had everything switched over.

Not sure how much other evidence you have, but filing taxes together is usually considered a big factor when they consider the validity of the marriage. it's not the only one, but again it depends how much other evidence you have to show co-mingling of financial resources. Even if you meet the requirements for the i-864 through a co-sponsor, taxes are likely to come up at some point (ie I-130 review or interview).

Since you've been married, how have you filed taxes?

Since you've been married, how have you filed taxes?


I'm pretty sure we have enough evidence, I have her on my health insurance, we have a saving account together, house rental agreement is under both our names, I've added her to one of my credit card accounts etc. We haven't filed taxes together because we got married this year, we are going on 9 months of being married. So in 2020 we will be filing our taxes together for 2019. My wife is currently in the process of filing her taxes for the years she hasn't filed so if they ask anything about that in the interview process we'll be ready, I don't recall anything in I-130 asking for taxes or financial documents. I do remember asking about my wife's employment history but that was about it.

Hmmm it is definitely important for your wife to consult a tax expert regarding her past taxes.

Regarding filing jointly, I think the joint account and combined insurance are strong evidence for AOS.

We were never asked during our Adjustment of Status interview about us filing jointly but that was my experience. The officer was more interested in us filing taxes as married, whether married filing jointly or married filing separately.

By our combo Removal of Conditions and Naturalization interview, we were never asked this either although by then we already had two children so perhaps that helped support the validity of our relationship.

Today I received the approval letter for my I485. I want to share my story with you guys in case any of you got a question you can PM me.

I EWI as minor in 2001. I was stopped by a cop in florida for driving without a license and when he found out I was undocumented he drove me to border patrol. I was then placed in removal proceeding and one week before my final court hearing Obama signed Daca. I applied for daca and my case was administrative closed. I used advance paroled to clear my EWI. Now my wife is my high school sweetheart and we have been together ever since. We got married a couple years ago and she petition me. Lucky for me she became an immigration attorney hehe. So she did all the legal work. We made the mistake to send the I130 first and then the I485 becuase we tought we had to terminate my court case before we could apply for the I485. I had to go for a I130 interview which was very stressful becuase the immigration officer was kind of rude. We left the interview and we was not getting an approval for a long time. One time my wife had to take one of her clients to an interview the officer in charge was the same officer from my interview. So he asked her if everything went good with our case. She mention that we had not gotten a response and he said that he was sorry that our file was probably just sitting somewhere on his desk. 2 days later we got an approval letter for the I130. We then submitted the I485 and it took out a year to get an interview. We went to the interview and our officer was much nicer. The interview went smoothly except for one thing. I had a court disposition that the court had email me. So I just printed it and brought it to the appointment. Well it turned out that the disposition had to be seal from the city clerk. She told me she was going to approve me right there but becuase we didn't have the right court disposition she could not approve me that day. But she told us that we can go to the court the same day and that we could just drop the disposition at the front desk. So we did that but nothing happened. We then got a RFE letter for that same document. We then took it again to court this time with the RFE document. 2 weeks later today I was approved.
