Limited Term Legal Presence

All original and pending driver license or identification cards will expire on the expiration date of his/her birth date and legal presence document (BD/LP) issued by the Department of Homeland Security (DHS).

Your BD/LP document must have an expiration date 30 or more days from your application date. If your BD/LP document has an expiration date less than 30 days, you will not be able to start a driver license or identification card application.

If your BD/LP document has an expiration date of less than 60 days, you may complete your licensing requirements (written/vision/driving tests), but you will need to submit another BD/LP document with an expiration date of 60 days or more before your driver license or identification card is mailed to you.

Before your limited term driver license expires, the department will mail out an “extension” letter with instructions on how to complete your application for a driver license.

If your current name no longer matches the name on your birth date/legal presence document, see "True Full Name" and "How to Change Your Name" for more information.

AB2189 HAS NOTHING.......... NOTHING................. To do with Expiration dates. It only deals with DACA applicants who are denied a Work Permit but their DACA approved so they can get a license without a SSN.

That is it....

Waiiiiiiiiit a second.

That right there backs up the licenses that expire in two years, as the EAD's.

By STATUE that is true.

But many people, including myself, have ID/DL that have been recently issued that are valid for the full length of time, 5/6 yrs.

Right. A majority of people are receiving them for 5 years. But, for those that do get it for two, does this mean that they could NOT fight it?

I hope we can, but, unfortunately, I doubt they give us a 5 year one.

But hold on, where did you get that quote you posted? Cause that's not the original bill, correct?

I found the original bill, and that exact wording is not there. The original bill doesn't say ANYTHING about expiration dates. Not even those of the legal presence document.

"The department may issue an original driver's license to the
person who submits proof of presence in the United States as
authorized under federal law pursuant to subdivision (a) and either a
social security account number or ineligibility for a social
security account number."

"an applicant who provides
satisfactory proof that his or her presence in the United States is
authorized under federal law, but who is not eligible for a social
security account number, is eligible to receive an original driver's
license if he or she meets all other qualifications for licensure."

YOU CAN fight it, if you can produce
  • A I-551 Legal Permanent Resident Card
  • A Visa valid for more than 2 years
  • A US Birth Certificate
  • A US Passport
  • A USC naturalization certificate
  • Proof of Asylum, Refugee

from the top of my head those would be the only documents that might get you somewhere.

The fact that the bill doesn't say anything about the expiration date on the DL being the same as the one on the legal presence document should be enough. The bill clearly states ORIGINAL DL.
