There is a guy that came in when he was 12 as a tourist, then left after 6 months and came back when he was 16 and 4 months and he got hos work permit. Based on this my brother will try to apply.

It sounds like this guy perjured himself by not mentioning he had left the country. I can't imagine they saw that he clearly had broken the rules and gave him a work permit anyway. Maybe that will catch up to him if/when the DA is passed - maybe not, but lying in official documents is a sure fire way to get deported.

what if you dont lie.... What if you use your entry when you were under 16 as your initial entry(821-D) and then your entry when your were over 16 as your las entry (i-765)
