Which is considered illegal: Overstaying.

You need to fill out I-821D, 765 and 765WS along with all the proofs, check and everything. That's what everyone else is doing and so did I.

Yea, thats what I was just wondering, if I needed to file I-821D as well along with I-765/ws. And one other question, I can send all my supporting documents to a Lock Box, right? For me, it would be in Phoenix.

Yes of course. That's why I said you need to do more reading if you are in a state of asking this kind of question.

Please refer to all the stickies on this forum. And the link I gave you before USCIS website link (it has everything you need to know).

Basically, you need those three forms, proofs, $465 check, 2 passport photos and etc.
And yes, every forms and documents have to be in one form of document.
ONE MAIL, not separate and not multiple mails.

Refer to filing guides, checklists and all sort of goodness.

Simplydivine If you are apply for DACA you MUST fill out I-821d along with I-765/Ws. Make sure that YOU read all the requirements for it and dont' take your uncles word for it. The fact that he would tell you you dont' have to fill out the I-821 d is just plain wrong.

For the I-765 you need to send in 2 passport pictures which you will lightly print your full name on on the back of each picture. A lot of people including myself are attaching 4 pictures to go along with the proof of identity portion of the I-821d submitted with birth certificate.

I was just so surprised to see someone asking if one should file I-821D.
That's what this is all about, the form I-821D. To get a deferred action.
Not sure what "experience" your Uncle had for USCIS but he's definitely wrong.

And please do the readings I gave you.
You said you did "whole lot" of reading but missed the important ones, the ones you SHOULD be reading.

I'm just nervous and concerning FOR you, that's all.

Thank you, but I think my uncle said I didn't need the I-821D is because he probably thinks I'm filing for a spouse petition, thats why he didn't think I need it. I would like to work first since (from reading all the DACA approvals), it seems like a faster process.

And also, I already have my passport renewaled, can I send in that one plus the old one? Or just the new one? Here's what I'm planning on sending out as a proof that I've been living here consecutively:

All old elementary transcripts/awards with dates & addresses
HS diploma
Bank statement
English translated birth certificate
ID's

Is there any thing else I should add that I'm missing?

Oh boy. For starter, send the valid passport, and the passport with your visa and arrival stamp on it to prove the date you entered the country.

Also send ALL relevant documentation you have. Don't leave nothing to chance, or you might get RFE'd (that's REQUEST FOR more EVIDENCE).

Read, read, read all the instructions again and again.
