Hello, I am hopefull since I read your story. My case is very similar to yours , I first came to the USA ( legally) when Iwas 14, and stayed for about 5 months, I was registered in School but becaUse my dad had financial problems I left this country and I came back until the age of 17. Since I came I have been studying, I am doing pretty good in college . Do you think is it a good idea to apply?

I needed to clarify that in case someone else was also in a similar situation as me. There is a difference in leaving the country when you were 15 versus having your 16th birthday then leaving. If u left when you were still 15 years old but came back when you were 16, they would require proof from you that you had established residence before leaving i.e. went to school. I'm also assuming that it's up to the case worker reviewing your case because I did leave for almost a year. That was a tough one for me. I kept worrying that they would deny me because I had left for almost a year.

You will be fine. You clearly established residence in those 5 months you were in the US and your proof is your school records. As long as you came back before june 15 2007 and have been continuously present since it doesnt matter if you left before that date as long as at some point you established residence.

yeah, what part of staying for 5 months and then leaving did you not get? he then came back when he was 17.. wut... that's a umm... 4 year gap... right there? he should speak with a lawyer.

LOL I did get it and my comment for him/her was after the law firm i work for recently had 2 cases very similar to this situation. Both applicants came before age 16 and were in school for 7-8 months respectively we are talking about months IN school and not 5 weeks of vacation (in case anyone who just came on vacation for a couple of weeks wants to apply yeah..no) and went back to their country and came back years later before 2007. Im not going to comment on something without having some sort of backing to my belief. I do however agree with you that he/she should consult/hire a lawyers but remember that Deferred action is discretionary.

I will say that Txgirl is correct my sister came here when she was 2 left when she was 14 and came back when she was 19 and guess what she was APPROVED. The World relief people told her that as long as she can prove she was here before the age of 16 she was fine. It din't matter when she came back as long as she has been residing continually since June 15 2007 she will be approved. and she was. last November

Hi DiosLover

You did establish residency when you went to school here. Your school records will prove that. And as Txgirl mentioned, as long as you came back before June 2007 (and meet all the other requirements), you should be fine.

My case took 6 months to be approved and the only reason I could think of why was because I left for almost a year. So perhaps yours will take just as long? Who knows, its really up to your case worker. They go on a case by case basis. Hopefully you get approved much faster than I did.

Anyone who's having trouble finding proof of verification, my wife came when she was 15 and 9 months. She didn't start school until she was 16, but thanks to her vaccinations card that showed that she was here when she was under 16, she was able to get DACA and now her green card.

The most a decent lawyer consultation could cost you is $300. Is losing $300 worth the opportunity of a life time? There is a LOT to gain. Go for it! Don't let fear hold you back. Just be truthful, ask many questions, and don't be afraid. Living in fear is not living, it is merely surviving.

I consider the attorneys I work for to be excellent attorneys who do want to help people and our consultations are free! so dont be so quick to pay such high consult fees do a bit of research on AVVO and the AILA website.
