I asked you, how did you leave the country, while in status or out of status. If you are gonna come here an brag about your departure prepare to explain how you went about your departure so people on this site dont get confused and think its ok to leave the country and come back. If you want prove somethig then please elaborate your situation. And for your information smarty snarky pants I previously asked you how you entered the country first ( to not assume ) and then how you left and entered during your departure. thanks for being defensive and lashing out it speaks out a lot.......

If someone would tell me i applied for daca but i had brief departure for 5 months i wouldnt kill his dream and say that wasnt brief u got no chance...i would try to help and say have faith and maybe they gona look over it not smack him in face and tell him itwasnt brief!

No one is killing your dream. I'm just saying that a 5 month departure is not brief. You can very well be approved BUT be aware of the risk to NOT be approved. Every officer is different and I'm sure they will look closely and make a decision. It is a case by case decision. If anything CIR is in the work and it looks promising.

And you said you were from Italy? I wouldn't mind getting deported there, it's a beautiful place. Ha..

If Mexico wasn't the violent, poor 2nd world country it is... I would consider returning. I love the USA but all the racism and prosecution is really sad.

You weren't denied for the month you didn't send evidence while being in Mexico because you don't have to provide continuous residence in Mexico since you aren't supposed to be out of the country in the first place!

Your departure was already deemed as not short nor brief, so I doubt you will be able to re-apply.

To the original poster, this advise is too late, but why even bother justifying the five month absence from this country? It is possible USCIS checks records outside the country, but I am certain it probably does not happen much, if at all. Even then, they would likely check a criminal record and not good behavior like school attendance.

In this situation, I would have gambled by leaving it blank and hope I was approved without those months; Some people have with similar gaps. If not, I would have waited for an RFE or sent anything with my name during the time I was gone. Like letters my family would of received when I left . I call it a loophole... Not fraud x)

Yeah lol i doubt i be deported but if i did atleast i get free ticket back lol im crossing my fingers they over look the 5 months tho lol
