It’s longer if you are from Mexico, Philippines, China or India.

You can file for I-485 (with Supplement A for 245i) and I-765 as soon as your PD is current like I did in October 2017. I did not qualify for AP since I was an Overstay status. As soon as USCIS gets the application in the mail. You stop acruring unlawful status and status becomes ‘Authorized Stay’.

I got my EAD approved in August 2018 because of the backlog and RFIE. EAD makes you a legal alien as long as AOS is pending decision.

NBC is backlogged. So the estimated 90 day rule to get EAD doesn’t apply. My lawyer did all the work. Hired the best one and highly rated.

You cannot adjust status in USA unless you had petition filed on or before 4/30/01. Most people now take the 1-601A route. If approved. The 3/10 bar no longer applies and then you go to your home country for interview and return if granted GC.

Must wait till Visa is available to file I-485 and I-765. In my case, waited about 6 years.
