This might be a dumb question, but can someone explain what EWI is and isnt?
I came here on a plane from S. Korea with a travel visa and overstayed - is that considered EWI or no?

No that's not considered EWI. EWI = Entry Without Inspection

EWI is entry without inspection (i.e. illegal entry).

If you came here through a point of inspection with a visa or equivalent, you were likely inspected, admitted, and given a travel admission form (I94). This kind of entry makes AOS much easier.

you will still accrue unlawfull presence and will be subject to 3/10 years reentry ban and subject to deportation . I'm not immigration expert but unlawfull presence and EWI bears almost same consequences.

Thanks for the answer! I hope AOS is easier... being S. Korean, theres an extra hurdle with the mandatory military service. Im worried that if DACA gets sorted out and we are able to get permanent residency, missing out on the military service may hurt me. Since I can't go back to S. Korea without being considered a criminal for dodging the military service, I would be arrested right away lol

At least with a legal entry, you can marry and adjust status in the US (even if illegally present). Ewi, you have to process your adjustment outside the US or qualify for a waiver which would allow you to adjust in the US. The waiver is difficult to obtain and as EWI you don’t have much of a way forward to get with the law

That’s right. If I remember correctly, someone on here had difficulty renewing their passport because of it. I think said person was able to get a deferment (through SK consulate) because they were studying in college. Anyways, I hope that this won’t become the issue for you and we all get green cards soon
