Questiono you still need prove extreme hardship to go through this?

You still have to prove extreme hardship... But I honestly feel that they are pretty lenient with the extreme hardship requirements. My sister obtained waiver and she and her husband didn't have any "extreme" hardship to present... I mean in my opinion being separated from your spouse for months or years is pretty extreme but not in the eyes of uscis. Anyways what I'm saying is that they didn't have any life threatening illness or situation and they were granted the waiver. I feel like that they focus more on whether or not you have a criminal record and the fact that you have triggered the 3/10 yr bar by leaving the US. I honestly feel that President Obama along with Secretary Napolitano and Director Mayorkas are very understanding to our community and are instructing uscis employees to look for ways to approve rather than excuses to deny immigration benefits, and I really think that it will be the same for this provisional waiver process, I mean look at the DACA requirements they are pretty lenient, don't you think?

Hey, Keep the Faith. It is approved but not published yet right? So, we have to wait for it to be published as I understand to speak to a lawyer. I'm going to get my parents to apply through this. I've been keeping a close eye on it and I'm waiting for the reports on it to come out.

I think I'm going to take advantage of this, I know that Dream Act will pass but it will probably come with a visa first then permanent residency. And now I won't have to be separated from my boyfriend for months, which is what was also giving me doubt. We have been together for over 8 years. I hope that I get approved once I apply.

Can anyone please outline this new info for me! I am married to a USC and have a 2yr old. Does this mean I will be able to file i601 from the usa? Then go to mexico and get my visa and waiver approved if my hardship proves to be legit? Im a bit confused! Any links would help.

The specifications are not out, but I would think you're a perfect candidate. Married to USC plus a child would create extreme hardship to your child and spouse if separated.

Yes this provisional waiver has been approved but we are just waiting for it to be published as a final rule in the federal register. According to the top waiver lawyer (laurel Scott) it will be published sometime within the next few days.

Im in the same position also. Ive been married for 3 years and have a child with USC.
