I doubt it you would have any issues. USCIS doesn't track what you do when you actually get into the country. Say you went for a quick visit then went back again when you had more funds to stay a longer time.

Hey all! So here's the latest update in my path to adjusting status...

DACA approved in 2014, got AP approval in early 2015, traveled to South Korea in August for 2 weeks and came back! I wanted to share my departure and re-entry experience at the airport with US CBP officers. Leaving the U.S. for my trip was no problem- I had my Korean passport so the airline attendant gave me a boarding pass and checked my bags. Leaving Korea, I showed my AP document to the airline attendant when he asked me if I had a visa for going to the U.S. He checked with another attendant and looked something up and then gave me my boarding pass... No other questions asked. My passport was checked once more right at boarding the plane, and the attendant asked if I had a visa, and so I just showed him my AP paper and he was fine with it and let me board. When I arrive at the airport I went to the visitors line (my husband who is a USC came with me to that line as well) and when we were called to the officer I handed him my passport and AP documents. He looked at my husband's passport and didn't mind that he was in line with me. The guy was really nice and courteous. He scans my fingerprints and takes my picture then hands me back my passport and AP documents and tells me to head to the secondary checkpoint which is a waiting room off to the side. He said the officers there will stamp my documents. My husband and I both go and I give my passport and AP doc. to the waiting officers. Luckily for us there were only 4 other people in the room so chances looked good that we weren't in for a long wait. My documents were looked at by an officer almost immediately and he called my name and asked if I had a driver's license and if I worked. I said yes to both and he asked how long was I in Korea? I told him and he said thank you, I'll try and get you out of here in 20 minutes. He was being very courteous also. Then he calls me up again to give me back my driver's license and asked me how old was I when I came to the states, where do my parents live, how did they bring me to the U.S., and where was I born? I told him all the answers, and then he had me sit down again. Then about 15 minutes go by, he asks me if I brought and food with me and I say only the chicken bun thing off of the plane. Well, because it had chicken, he said I had to go through the Agriculture check line at security. He said good thing I told him, because had it been discovered in my purse it would have been a $500 fine... He gave me back my passport with a stamp on a page that read "Paroled" until the day after. I believe it's the standard stamp given for AP travel. He took my fingerprints and picture again and told me where to go after I pick up luggage and said "welcome back".

Whew!! I was so relieved that it didn't take any longer and that everything went so smoothly! When the officer was looking at my documents it seemed like he already knew how to handle the AP status... Another officer also said "President Obama signed it into law" talking about DACA. Another officer was asking about DACA and AP travel and was asking the other officers "so what's their status" after she was told that AP is only valid for one day after coming back to the country. The overall impression I got is that most of the officers knew about DACA and travel with AP. I was happy that the officer handling my paperwork was so nice. He was very professional and seemed like he wanted to get me out of there fast. There was one guy who had a green card but he seemed to be in trouble because of his lack of time spent in the U.S. based on what his officer was telling him. Another couple came in after me and didn't speak any English and didn't understand that they were told to put their paper in the waiting file and sit and wait. The same officer who was looking at my papers was very stern and almost hostile in repeatedly telling them to wait. Apparently they had a connecting flight and were trying to make the officers hurry up. They didn't like that at all, and were actually going to make the couple wait longer, saying that they could care less if they had a connecting flight. The officers really want you to do as they say, which is understandable. The way they see it, you don't have a right to demand anything if you're in that secondary waiting room.

After the room, my husband and I got our luggage which was thankfully still waiting for us, we go through the Agriculture check line, they were fast and nice as well, and we were finally home free! My advice after my own experience at Customs and Border Patrol is to be extremely courteous and truthful, and do everything as the officer tells you. That person pretty much has the power to let you back into the country or not, so you want them to feel favorably about you from the minute you get to security. Do not rush them in any way, as I learned from the poor couple who probably missed their connecting flight. (The officers were going to make them wait for a translator.) And I don't know if the green card guy was let back in... The conversation between him and the officer was not looking good when I left.

Now with this stamp in my passport, and my recorded entry into the country in the system, I'm no longer EWI and I am eligible for apply for adjustment of status through my husband and hopefully will get my green card soon! I'm contacting my lawyer that has done all of my DACA and AP paperwork for me and we're going to get paperwork started for adjustment of status! I'll keep updating everything as it happens here... That's great! Yes please share your experience with that.. I'll post updates as well. Are you applying based on marriage to a USC as well?

Yes marriage to USC. got my medical done. Now finishing the i864W. 485/g25/1310 complete. Cover remain as well as 765 and 131. Expect to finish by end of week. Travel next weekend and send in following Monday.

Should i submit the biometrics fee of $85 even though my bio's were done in Jan? it is still within the year. thoughts?

Yes you still have to pay from biometrics what they can do is exempt you from taking it but the fee has to be payed regardless

I am emailing back and forth with my lawyer as we speak. I'm waiting for him to send all the documents so I expect to apply within the next couple weeks.
