Though I think the judge would have still come up with the same conclusion, he really shouldn’t be making an error like this:

1st sentence of 2nd paragraph in 5th's ruling has massive factual error, stating the DACA "Memorandum applies to “certain young people who were brought to this country as children” unlawfully and and would otherwise be removable."

Very many came legally & later lost status 1/2

is a mistake that gets made relatively often by many in the general public.

That Federal judges who are throwing the of lives of nearly 700k DACA recipients and another 1.5M family members in their households into chaos don't understand basics on the law is VERY troubling.

Ha. Same. Poor person has let this situation really take a toll on them to make them so angry in life. We can only wish something good and decent comes from all of this so they are free from the trauma and the forum is free of them.

Moving on...

I must say that while I understand how difficult it is to get Congress to move on this, the lip service from VP/Biden/Durbin has been lackluster. What are the actual options they have without Congress? Not many.

My hope now is that Democrats somehow hold the House and expand the Senate. Or that enough Republicans side with us to allow legalization if/when shit really hits the fan.

How many Trump appointees in the 5th?

As I understand it from reading NYT, it's kept in place (for now), current recipients can renew but told court to reconsider Biden DACA as Obama DACA has the procedural misstep that Biden DACA fixed?

Two of three.

The part I'm confused about is... Hanen had the opportunity to pull the rug from under us when it was in his court but left renewals because of how many people it would affect. Will his decision with the updated rules be the same, especially if the correct process (public comments, etc.) was followed by Biden? If he leaves renewals, what happens then? If Hanen says that's it, it's illegal and cancelled and the Biden Admin. appeals, then it heads to SC?

A timeline estimate for all of this would be so helpful, it's so unpredictable. Will Hanen expedite his decision?
