Hi everyone, first time posting here, but this thread has answered a lot of my questions in the past so thank you for that. I applied for AP (for work related reasons) in March 2016 and received the permit in late April, traveled to Mexico in May for a couple days and returned safely through the San Ysidro / Tijuana border, no questions asked, everything went smooth. I have now applied for Ajustment of Status via my USC wife. Just wanted to write here and see if anyone had any questions, maybe I can help, thanks again!

I don't think there's any complications, I would fill out my renewal for DACA right after you get approval for AP and you know the exact dates you will be gone, that way you can put the correct dates on the DACA renewal application, and then I would have someone you know send it out halfway through your trip to your country since you'll be gone for 2 months you don't want to submit it early and then get the fingerprint appointment while you're gone and miss it. So I think submitting your AP in january is a good idea, that way it gives you time to receive the permit and fill out the DACA renewal and then have someone send the renewal maybe in august so you can come back in time for your fingerprint appointment. hope that made sense.

Thanks for sharing your story, I plan on doing the same. I will be traveling on AP next week, hope to submit AOS paperwork shortly after my return. How long has you AOS case been pending? Do you have an interview scheduled yet?

Good luck and have fun, what border will you be going through? And no I just sent the applications for AOS this Monday (9/12), they received it on Tuesday (use express mail option for fast delivery its only like $22). So the waiting begins, hoping everything turns out good. Btw, if your background is clean and there's nothing complicated in your case, don't get a lawyer for AOS, its pretty straight forward, save yourself a few thousand dollars.

Thanks. I'll be flying to Zacatecas from Chicago. I'm thinking about submitting the AOS myself but the only thing holding me back is the affidavit of support. We want to use my income since my wife is a full time student but I have to read the instructions thoroughly.

The affidavit of support is pretty straightforward once you read the instructions carefully. We used my income too, we submitted all the sheets of last year's tax return + W2's for both me and her (you can include the last 3 years but not mandatory, just the last one). On the actual applications form it asks for HER last 3 year's $ TOTALS, but for evidence you only need to send copies of last year's for both of you (tax return and w2's). Has she worked any of the last 3 years? As long as your income is greater than the requirement I don't think it matters if she's worked or not tho.

Other than that we also sent her birth certificate and a letter from my employer (with letterheard) that I will still be employed afterwards. I did not have to provide evidence that we live in the same household since I'm the spouse and I have no accompanying dependents. 2012 was the last time she filed taxes. I've filed mine since 2013 and have already requested IRS transcripts for the past 3 years to send in place of W2s and tax return paperwork. My income does satisfy the min required. We are planning on having her write a letter explaining why she's been unemployed (school/baby). You mentioned you sent her birth cert, was this to prove she was a natural born citizen or specifically as evidence for the affidavit of support. One last question, what does the employer letter have to say. I want to word it properly when I ask them to write it so they dont think Im looking for them to sponsor me.

Thats good, that letter will help clarify why she hasn't been required to submit taxes.

I sent her birth certificate required specifically for the affidavit of support portion. For the employment letter this is what it looked like:

(Company letterhead)

(Date)

Dear Department of Homeland Security,

This letter is to affirm that my employee: (Your Name), a key member of our (insert your department) team since (date) will continue to be part of and employed by (company name). Our continuous growth will allow (Your Name) numerous advancement opportunities for years to come. (Company Name) is a (industry) company based in (city, state), offering (specific services).

If you require any additional information, please do not hesitate to contact me.

Thank you for your assistance.
