I have a question. I am submitting my AOS packet on the 8th with my lawyer. For my sponsor my wife does not make enough money to sponsor me. She is a server and sometimes tips tend to fall thru the cracks lol
I asked my best friends boyfriend to sponsor me and he is doing it. Not married, single. He made 22k last year. Will that be enough for a sponsors?
We just recently got married no kids..

How much evidence do you put? What evidence did you guys provide for bona fide marriage?

I feel as though I didn't put enough evidence. I put joint bank statements (just 3 month's worth because it would have been a lot), Amazon invoice from 2012 showing he bought me gifts with my name, an invoice from the purchased engagement ring, my CC statement with new marital name, and car insurance with both of our names on it. Also, pictures from the past 5 years. (Like pictures with family and friends, our college graduation, etc.) I had notes from Edible arrangements that he bought me but no date, so I didn't bother to include it.
You will be fine! When we did ours we only included our marriage certificate and lease as proof of Bona fide marriage. We brought pictures, joint bank account information etc on the day of our interview, presented only what they asked us for and we were approved on the same day.

Check the poverty guideline they have here: https://www.uscis.gov/i-864p

Keep in mind, although he is single, not married they have to consider his household size plus you. So, if he lives by himself (no kids) plus you, that'll be under 2 which is $20,025.

You can include your wife's income, although it's not enough, but it must be verifiable. Which means tips also have to be accounted in the tax return. You can have her employer issue a letter, paystubs, etc.

If you've retained an attorney, that's something you would have to address with them.

I have a question for those already approved through their marriage application.

Were you required to attend a biometrics appointment if you had valid fingerprints already from your DACA application within a 15 month period?

I ask because there is 15 month validity period for fingerprints.

Ianus.... Can you show me where it says there is this validity period for fingerprints?
I only ask because USCIS doesn't seem to be adhering to this policy. I plan on writing them and pointing this out. I just did fingerprints for daca. Do not want to do them again for AOS.

After USCIS receives your application, USCIS will provide you with a biometrics appointment letter with the location of the nearest USCIS authorized Application Support Center (ACS). There is no specific timeframe for scheduling of the biometrics appointments, although most are scheduled within 90-120 days of filing. Note that the results of the fingerprints are only good for 15 months, so if an I-485 is pending longer than 15 months (likely for quota backlogged cases), you will need to be re-printed. For this reason, USCIS sometimes elects to delay biometrics processing to avoid multiple visits to the Application Support Center.

Yes but can the biometrics done for a non I-485 case like Daca be used for I-485?

Honestly,

I think you should do the fingerprints again. Because you did him recently there is very likely that they will be approved 1st day.


I imagine that once the request reaches the FBI for another check that it will be automatically sent back to USCIS.


To be honest, yeah I have not seen whether it can be done for a different application.

I do not see why not it couldn't.

Thank you! They interviewed my US Citizen spouse first then I was asked to join the interview. The interviewer asked me our full names, husband's date of birth, if he has any siblings, asked me if I had ever met his family, when last I entered the US (never traveled out since I was brought here as a child). I was also asked details about our apartment, asked how I met my husband, asked whether my husband has ever met my parents and siblings, I was asked their names, I was asked if we had ever taken any trips together. The interviewer asked us to leave some pictures from our photo album and also provide any documents that shows comingling. We had bills with our names on them as well as insurance documents. We were thankfully approved on the spot.

Good question, in my experience I went for my DACA biometrics in July 2014, then I applied for AOS in October 2015 but was sent to do my Biometrics in early December 2015. Around March/April 2016 I applied for another EAD based on my then pending AOS application and I was sent a notice that I would not need to go for another set of biometrics.
