So I got "arrested" today after jumping the turnstile. I didn't have any ID on me, so they had to take me in. I spent about 3 hours in jail while waiting. Whlie there they took my finger prints and pic apparently to send to Albany to check if I was clean and was who i said I was. The cop told me it was a simple violation (i quizzd him vigorously) and that I shouldn't worry. But the thing is, I did my Biometrics last Friday via walk in (Yes, I know I already beat myself to death over it, so dont please) Also, for future employment purpose I am worried. He gave me a date to appear before the judge, which I don't know what to expect being having served those hours in jail, i cannot be fined again(double jeopardy i was told) So what am I to expect? Can I ask to have this dismissed? sealed or whatever! Also, what are the chance that this will influence my DACA? Do you think the FBI has already done my check....Help guys I'm scared shitless hahaha. Gonna go hit the sacks, tired. I await your responses. I'm from NYC btw

Criminal history? Age?

Expunged is the removal from general view and seal is for those who are minors when they commit said act. They are different. It shouldn't be in your record until you are found guilty in court which you have yet to do.

Jumping a turnstile in New York...LMFAO. Hope that $2.50 you saved was worth it.

Sorry to hear u got arrested but I gotta ask ... what were u thinking? This DACA puts us in a delicate situation. They have us on file and they are looking for any excuse to deport us. Until we get citizenship, we all have to be extra careful. Don't take any unnecessary risks. Jumping a turnstile, that is just dumb I'm sorry to say. I hope it doesn't affect your DACA and I hope u learn a lesson. This DACA is a privilege, not a right. Don't forget, anything time u get on the wrong side of the law, u risk losing it and there isn't a second chance bro.

That counts as a minor misdemeanor I believe, so unless you have 2 more of these (as states in the rules 3 or more minor misdemeanors), you should be fine. As far as jobs, you should be fine also. Unless you get a major misdemeanor or a felony, then that would appear on a normal background check. Anyway what were you thinking? can you give your self a slap on the face for me?.

you will be fine. just declare it IF they send you a letter asking about it in case you are RFE'd.

source: i had 2 small misdemeanors of which i declared to USCIS (sent court paperwork, the whole nine yards) and still got approved.
