for those of us who are well over 18... who overstayed the visa, are we officially felons or criminals since it is a felony to overstay a visa?

If we voluntarily leave there isn't any criminal record is there? How about if we get deported, does deportation mark us as criminals?

As far as immigrating to another country, how does this play a role? Wouldn't those countries find out that we overstayed our visa here in the U.S. and that we are criminals? New Zealand even asks about police reports...

you seem to not know much about this matter. Overstaying a visa is not a felony. Is basically a civil offense... Almost all Asylum applicants overstay their visas. And no, nowhere is gonna say that your a criminal, you wont have anything on your record.

other countries won't even know about your stay in the United States, they don't collaborate with each other. I believe Canada shares some info with the U.S, but limited. so they dun care...

but police record of your previous residence???? that's wut new zealand requires in immigration process

Countries do care, like New Zealand. If you happen to get deported from the US, you wouldn't be able to get a visa New Zealand. This is also the policy for many other countries. They find out by making you turn in some official police report before they grant you a visa.

If you self deport yourself, I don't think that violates any of their policies, even if you overstayed your visa in the US. To make sure though, I would contact the immigration service of the country you are interested in.

Well, I mean if you are going to leave by yourself, then you are fine. Just don't get deported, and try to apply, because you will be rejected. NZ didn't have any policies against overstaying visas in another country. It only if you get deported from said country.

Overstay is considered an civil offense, like Alex said. As was said previously, NZ does require that you not be deported from another country. So, if you were to leave the US on your own, you could still apply to NZ, but I don't believe you can apply if you are residing in the US out of status. You'd have to go back to your country of origin to apply for a visa.

ok, yeah I remember talking to a lawyer about that. I knew that much, I just wanted to make sure New Zealand wasn't going to deny me a visa based on that.
