Any hope for an EWI?

Hello
I'm an EWI and my parents are both citizens.
Is there any way i can legalize my status or is it hopeless?
What are my options?

Yes! They can petition you and then they will file a waiver for your illegaly presence in the US. You will have to go back to your country of citizenship for a visa and waiver appointment. However if f they can prove that it would cause them a lot of hardship if you were banned from the US for ten years, you can come back fairly quickly.

But it does depend on how old you are and your marital status.

Im 17 and will be turning 18 soon.
should i go back right after graduation?
and may only one parent do it or both have to? because i know my mom is but she has a different last name then my dad and i because (i dont know the real reason) i think she doesnt want to use our last name... so how do i actually prove she is my mom?
and do you have any idea how long?

Well, I think only one has to file a petition for you. When do you turn 18? Is it before graduation? I would say that you might want to go back before you are 18 so that you won't have a ban from the US. Talk to several immigration lawyers before you leave the country, though. Don't do anything drastic before knowing all your options.

And as for you mom, you would use your birth certificate as proof.

yeah i was trying to figure out what EWI meant too.

we should make our own glossary of commonly used abbreviations you know for any newcomers.

Ditto ^ Just wanted to clarify something though. Right now you're not accumulating unlawful presence because you're under 18. You start accumulating unlawful presence after you've lived 180 days illegally. So you don't have to leave the US until 18 1/2. But if you can leave before the 180 days, it's better. It will make your process a lot easier and you will not need a waiver. Good luck!

If you had entered legally & overstayed it would have been pretty simple to stay in the US & in fact become a US citizen if still under the age of 18.

The only thing that can be done at this point is to have your family process the paperwork & have your adjustment interview in your country of origin provided you have left before 18 1/2 years of age.
