Bad news... can anyone give me advice??

Ok, guys, so this is what happened...
My step dad is living in Jacksonville, FL, I believe (not really sure, I rarely ever hear from him anymore after I moved from O town), staying with roommates there to be able to find jobs as a construction worker (he installs tiles, laminates, etc), and obviously he is as undocumented as me.
His Driver's License expired a while back but he still drives - he's gotta, for obvious reasons.

Well, I actually just recently found out that he had a serious accident while at work... got electrocuted while using some machine outside while it was raining I believe, not really sure of the details. Passed out & was taken to the hospital, where he stayed at for three days straight. At the hospital apparently they asked his boss for his work permit papers, I guess for insurance reasons and whatnot, cuz he did suffer an accident while AT work, and his boss answered that he did have papers... but couldn't prove it, duh.
I'm not exactly sure of the details, but my dad just called me like, 5min ago... he didn't tell me much at all, but he did tell me that they had sent him to court cuz of that, he was just leaving it when he called. He told me that basically what they did at court was tell him they were gonna check his stuff & his papers and whatnot, and get back at him later.

So now my dad is saying that they're most likely 99% positively gonna check with immigration & find out about his status & background. He came into the country the same way as me, with a Tourist Visa, & overstayed (but of course, unlike me, he was already an adult), && he came mainly so I wouldn't be left alone, too...
So now my dad is also saying that he's probably either gonna get a Deportation letter in the mail saying he's got X days to leave the country on his own, or worse, they might even knock at his door to take him.

That is all stuff he just told me... and I had absolutely no answer... so my heart is heavy... I don't want my dad to go deported...

Does anyone know anything about this kind of situation??? What will court do? Will they really deport him? Is there any way he can stay, anything he can do? Petition for something, idk?

Alright... so I talked to him tonight and got a few more details...

Apparently the BS that happened wasn't through the hospital, but through some insurance agency... AT the hospital, while my dad was unconscious, they asked his boss for some number (I'm thinking a social? But not completely sure) to prove that his employee (my dad) could get worker's compensation. But my dad's boss apparently lied and gave them some fake number, or someone else's number or whatever, under my dad's name, and of course they found out it didn't match... so they must've reported it or something, so that's how my dad got a letter straight from the court saying he had to show up there...
At the court, he told me he explained that he had no idea what was going on, cuz he had been unconscious at the time that his boss gave out the false information, yadda yadda.
So my dad told me he also got a lawyer, and the lawyer was the one that said he might receive a deportation letter in the mail - if they contact immigration, or something, I guess. But also said that there's a possibility they might just send him a fine...

Any thoughts on that???

Ugh, this is so horrible... if my dad goes deported, chances are I don't even know WHEN I'll see him again... he won't be able to come back in, & I can't leave cuz then I'd have a 10yr ban... and even if I for some reason leave the country as well & go back, he's not even going to the same state as I would go to...

Not sure the right answer...Does he have a social? My dad has a social (his own, from back in the day when it was easier to get) and he got into a bad accident that required worker's comp. He never got deported...But I don't think they did a background check..Good luck..Keep us updated.

Nope, no social... he got here in 2004, about a year after I came...
He's got an ITIN but that's about it...

I don't understand why he went to court. He didn't do anything criminal right? He just suffered an accident while at work so I don't see why they would get ICE involved. Explain why the court got involved in the first place.

I actually have no idea... he just called me right after he left there, or so he told me. And he also mentioned that they asked for his papers at the hospital (things like social, or work permit, or visa, etc), and instead of saying he didn't have them, his boss told them he DID, but apparently they found out it was a lie? I'm not sure about the details, unfortunately... my dad and I were never to talk much (it's somewhat explained in the story I wrote about myself in another thread), so even when I kept asking for details he kept avoiding them. He always does that.
To me it sounded like he was sent to court cuz they found out he was working illegally? Can that happen?

I was just hoping to hear something useful here, so I could call him back and ask for more details & have a reason why... y'know?

That's not good I remember one of my dad's friends suffered a horrible accident where he got electrocuted while working construction. He suffered severe memory loss and the doctors said his chances of recovery were slim to none. Thank God though he has been slowly recovering his motor skills and some memory but anyways he is illegal. Even though he is he got a lawyer and his son who also was electrocuted and is much worse condition are close to getting a 500,000 dollar each settlement because he was working for the company. The company is responsible for your dad and he should try to get legal action and I don't know why a hospital would ask about his status.

I think the people who owe the company he works for are also illegal, tho...
I'm gonna call him again tomorrow to try to ask more about this...

P.S.: "electrocuted" was the word I couldn't remember when I was writing the original post LoL ty.

Damn if they are illegal he might be in trouble then I just hate ICE they are always in peoples business when they don't need to be. Even though drug traffickers are illegal and running drugs all over this country but they don't care about getting them.

Okay, there's definitely something your dad is not telling you. The hospital has no business meddling through a patient's immigration status. In an emergency situation, they're required by law to treat anyone regardless of it or their ability to pay.

Now, I'm sure they asked for a SS number at some point. But being unable to provide it does not land you in court. Hypothetically speaking, if your dad had been billed, and then he failed to make the payments, a collection agency could take legal action, but I don't think this is the case considering how he ended up in litigation right after being discharged from the hospital.
