confused??

hey,
i was wondering if i would be eligible for the dream act. my mom married a usc, he petitioned for her and my sister and i were added to the case, i was minor but my sister was not. long story short, around 19/2o yrs , were were denied and sent a denial letter saying we have no reason to be in the us , so we should leave, is this a voluntary departure notice, would i still be eligible for the act, i fit other requirements except for this, do i have options, im hoping to start medical school, im beginnig to see there is no point to this.

But to make long story short for you, You will qualify if you came to the country before u were 16 and have been here ever since. The reason why you probably got denied the papers through your mom's marriage is because you guys applied after you were 18 and a half, I think after that age you don't get to apply through your parents anymore or if your older you have to go back to your country and wait and etc.. But ya if you came in before you were 16, then u qualify.

thanks for the answer but i read somewhere that if you have a voluntary departure notice/letter or deportation notice, you would not be eligible. Was the denial letter telling us that we have no reason to be in the us a voluntary departure notice.? sorry for all the questions, i just dont want to get my hope up in the act only to find out i dont qualify WHEN ( hopefully) it passes

Now that... is a good question actually.

If that were the case, then what was the point for ICE to not enforce the deportation of the several students who made news last year? They did it because they'd be helped by the DREAM Act. When DREAM passes, they will either need to appeal before applying for relief or maybe benefit from an amendment to the act that would eliminate the effect of an order of deportation for reasons other than criminal behavior.

I don't think it would be a VD order (but I might be wrong since immigration issues can be really complicated - it could just be a denial of the petitions).
I think you'd have to be put into Removal Proceedings before you could request Voluntary Departure (which is better than the U.S. deporting you).

If it was a deportation order, ignoring it would have serious consequences for future Permanent Residency. But, first, consult a lawyer before doing anything drastic.

Good question..not sure the right answer to it..I wanna say that may be a problem in your eligibility for Dream Act..You may wanna talk to a lawyer on what you can do..or you can go the "Do I qualify" page and click on the link at the bottom that directs you to the "DREAM ACT" itself and read the fine print.

You "age out" in terms of immigration benefits derived from your parents when you turn 21.

* As far as being petitioned through a mother who marries a U.S citizen I believe its 16..maybe that's why you were denied...

And there is the Child Status Protection Act for those who have aged out (in some cases)
