USC brother turning 21

well my brother will be turning 21 next year, so he will be able to start petitioning. How long would it take for my parents to adjust their status once my brother petitions for them? and how long would it be for my parents to help adjust my status once they get their green card? yes, i know my brother can petition for me, but its a way longer wait.

Also if this helps my parents and I paper work, have been in process for the last 9 years on the behalf of my moms brother filing for us.

i just turned 22, but i think i know what your getting at. if i was minor i think it would of been a different story and i would benefit of my brother.

1.It would only take 5-9 months for your parent(s) to adjust status through your over 21 year old brother provided that they entered the US legally & overstayed or be covered under 245i which one of them seem to be due to the former petition by your Uncle for you Mother.

2.Can't say how long it would be since you never mentioned country of origin,but you also seem to be a beneficiary of 245i as well if you were placed on the application at the time.

sorry, i should of mentioned were from mexico who EWI. yes im pretty sue were under the 245i are stute is under approved for a while i think like 5 years if i remember correctly.

Like Ianus said, 6months to a year for your parents to finalize everything.
As for you, you will have to wait a while. Since you're from Mexico, probably 13-15 years.

I'm on the same boat as you, just that I was petitioned last year.

When my sister petitioned for my mom... she filed in Feb 2003.. and my mom got her green card in Sept 2005. Just to give you an idea.. It takes about a year or so just to get approved.. things might have changed for better or worse though.. and Mexico has one of the longest waits in regards to you being able to adjust your status (sibling petitions are last priority).. You can however have you parents file for you once they become permanent residents. Either way, getting a consultation from an attorney is the best way to go.. no matter how much advice you get on here, EVERYONES case is different.. even if they sound similar. Good luck. ; )

PS: My mom did the paperwork herself, which may explain why it took her so long... hence, getting an attonrey to guide you and inform you about they best way to go is the key.

If you have the money, then I suggest getting one from both your mom and brother.

I believe it takes about the same time. Like the poster above me said, everyone's case is different, but it's just so hard to find a legit lawyer these days that won't charge you through the roof.
